please tell me what happens if this act is broken.

Is it true that you can sue the offending party for up to £5000.00?

No. The offences defined by the Act are crimimal, and the figure of £5000 appears in the Data Protection Act 1988 s60(3). If a court imposes that fine, the money is paid to the court.

I dont't know about that. The offending individual can be fined £5000.00 but that doesn't mean you will see a penny of it, A company or organisation can be fined more also I think. A fine of course is distinct from anything you might be awarded and te injured party gets nothing from it. I think if you wanted to sue you would have to be able to show that you have lost out in some way because of the breach of the Data Protection Act.
