If an employee has been off work suffering from mental health problems for more than six months, what is his entitlement a propos Duty of Care from employers? The employers have made no contact with him whatsoever to establish progress, wellbeing etc. Is he covered by the Disability Act?

Thanks for the response - I see what you mean,but my friend see this as negligence. He wants to return but feels he has been given no encouragement and is now talking constructive dismissal!

Afraid not babe, he must have a good boss! for not making any contact he understands what he/ she is going through. Hope he gets better soon, and his boss allows him to ease himself slowly back into work.
