specific performance suit decreed for immovabale property. during pendency of suit one defendant died. one of the L.Rs was not impleaded. In E.P. the sale deed was registered in favour of the D.Hr by process of court. Now the E.P. is coming up for delivery of property. Can the L.R. who was omitted to be impleaded in the suit agitate in the E.P. court under section 47 of C.P.C that she is not bound by the decree and that her right in the property which was devolved on her on the death of the deceased defendant remains unaffected and that the E.P. itself is liable to be dismissed for inexecutability?

OK, the situation is something like this-

Company X has a contract with me, an individual. They owe me something-they have a liability towards me. Now, if a company Y takes X over, (it's a takeover, so X's identity is lost), is Y a stranger to the contract?

It's driving me absolutely nuts. Help, somebody!

I moved in my house 4 and ahalf years ago, my neighbour moved in 6 months later. We are both council tenants. I had had awful noise and anti-social problems with her before but involving my housing officer who threatened her with Social Services seemed to stop the almost contstant music and violence between her and her boyfriends. But things are happening again, I have had her drugged up boyfriends knocking on my door all hours, one even barged past me in my doorway in the middle of the afternoon because he was so high to realise he had got the wrong house. Last year I had to call the police again because men were outside threatening to come back and burn her house down and then last night someone was trying to smash their way through MY front door. I was terrified. Called 999, they were great who came straight out and got this guy. A 'friend' of hers next door who apparantly had no where to stay and was trying to wake her up! I am at my wits end? What should my next step be?

What could possibly be the reason that elementary school children be taught anything about sexual preferences or anything to do with sex? The judge ruled that the school can teach anything that prepares the kids to become members of our society. This same judge would have to rule against teaching the kids about adam and eve or Jesus. Are these subjects not part of our society? Elementary school children do not need to know about dick sucking or anal penetration to prepare them for society.

I just read a article about the Federal Court in Boston Allowing a book about gays to be read in elemebtray school against the wishes if some parents. The judge said that this was not for sex ed but to teach the childern about other sexual orientations & that the religious teaching of the parents to the child were not indangered.So you can teach a child it is OK to be gay or Lesbian in school but you can not bring a bible to school?The judge also saidthis expossed the children to contary ideas in school. I have a idea. Instead of teaching it is right to teach about life style , lets teach them how to read, write& count. but now you see the agender of the backers of gay marrage in MASS. They want their life style in all of the state. How about my life style being taught?I am married to a women (41 years) Have a child ( by me , not artifical)& i guess no rights to my beliefs in the schooling of my child.Isnt this DESCRIMNATION??

and a decision to be made between a woman and her doctor, then why do we need abortion clinics?

Many people believe that abortion should only be for rape and to save the life of the mother, or fetal anomaly, therefore, can't a woman's doctor do the procedure if that is the case? Apparently, these cases for abortion make up less than 2%.

Wouldn't this cut down on abortion-on-demand as birth control--which many pro-choice people view as wrong--and make abortion truly safe, legal, and rare?

PS--If it matters, I am female.

Judges seem to be in a hurry to decide cases. Sometimes they simply adjourn! Sometimes they come late! Are they answerable to the society of which they are a part!! Can they be hauled up for delaying cases!

Lets just say that Howard K Stern is granted paternity of Dannielyn because of the Bahamian law of him being named on the birth certificate despite Larry Birkhead proving he is through DNA. I think that can still happen if the courts decide it.
Do you think if Anna's baby does get the millions that Anna was fighting for, that Larry coud claim to be the guardian of the money instead of Howard? as the US may recognize him by law as being the legal father.
Sounds impossible, but I wouldn't be surprised if that kind of lawsuit popped up later as there seems to be one lawsuit after another with this family.

I participated in the monthly blogging contest of ibibo.com and had a Blog title Soulful Poetry to Change your lives and you...I posted to this blog thousands of posts working day and nights...expecting that I will emerge amonst top bloggers.The contest for february month was to end at 12 PM night on 13-feb 2007.My hardwork paid off when I found that I was ranked 49th at 11.48 PM on 13 feb 2007.To my horror I found at 12.01 that -just two minutes later..that I was relegated to rank 154 .In two miutes flat,without giving me any reason or assigning any cause the website had manipulated my rank down by more than 105 positions.There was no way by which any other competing blogger could overtake me by posting in those 2-3 minutes.I was entitled to a prize of Rs.40000 ;however I checked up later from site records that now it went to another blogger who had posted much less.My 15-20enquiries sent by emails/feedback to website got no resonse.Could you tell me where I can seek redressal.

My wife divorced in 1993 and agreed in the courts / land registry he would stay in the property til he dies, at which time it would be sold and divided between the kids. He has now remarried, moved to Thailand and let the house out for £200 a week. Can he do this? And is there anything to be done?

My Landlord has failed to action against another Tenant for Noise & Disturbance even though the Tenant accepted a Undertaking in Court twice, the Undertaking has now expired.

Can i take action against my Landlord for Breach of Agreement for failing to ensure my Peaceful Enjoyment???

I have requested during the period of the Undertaking that the Landlord take action, but they refused. Now they are taking action but i have to go through the process all over again and have suffered further Neighbour Nuisance due to the failings of the Landlord. Any advice welcome. Thanks

It would be even better if the victim of the crime was given the chance to birch the person who commited the crime against them.. I would rally enjoy birching someone who had maybe mugged me and stole my mobile phone and wallet. I think it would make them think again before ever doing that to somone else. Crime figures would come right down and the streets would be a safer place to walk.
