How do you locate a deceased family member's will if it was not publicly filed in a courthouse? How do you find out which lawyer it was filed with?

This can be very difficult. A copy of a will should always be given to trusted family members or friends to avoid this problem. Obviously, that was not done in this case. You can place an ad in the local bar association newsletter asking if anyone drafted a will for the deceased. Check the bank for a safe deposit box and search the important papers of the deceased. If you do not find a will, the estate will be handled through the laws of intestate succession in your state. Generally speaking, this means that the closest relatives inherit the assets of the estate.
