Your response is noted. It wasn't a headline when I looked for it, but I tracked it down anyway.
If you had actually read the court's opinion in Parker v. Hurley (C.A. No. 06-10751-MLW), U.S. District Court, District of Massachusetts, issued by Judge Wolf on 23 February 2007, you'd understand why he had to rule that way. Court opinions are there to be read by people like you and me, not for me to read to you.
Since you either can't find it, can't read it, or can't comprehend it, allow me to break it down for you:
The Parkers and their coplaintiffs claimed that their Constitutional rights to raise their children and freely exercise their religion were violated. They also claimed that the defendants violated Massachusetts law, including one requiring that parents be notified and given an opportunity to exempt their children from any curriculum that "primarily involves human sexual education or human sexuality issues." See M.G.L. c. 71, §32A. It too is there to be read by people like you and me, not for me to read it to you.
The defendants moved to dismiss the case on the grounds that the plaintiffs failed to allege any facts constituting a Constitutional violation or a violation of federal law. Because you need a federal question to get into federal court on a nondiversity case (one in which one plaintiff and one defendant are from the same state), this required dismissal. Federal courts are courts of limited jurisdiction, and may only hear nondiversity cases involving a question of Constitutional or federal law.
The plaintiffs' federal claims were dismissed with prejudice. This in essence says "hit the road, Jack, and don't you come back no more no more no more no more."
The judge dismissed the plaintiffs' STATE claims without prejudice, and they are free to refile those in a Massachusetts court.
Short version: The federal judge was without jurisdiction to decide the case on the merits, in the absence of a federal question. The defendants can toddle on down to a Commonwealth court and file their complaints of State law violation.
You should also note that the judge did say that nothing prevents the school district from voluntarily accommodating the parents' concerns.
Of course, you'd know all that if you read the opinion instead of just getting snooty.

Well, with a very few exceptions, every school child will at some time or another engage in sexual activity. While I agree that it is the parents job to teach their child sexual responsibility, I will state that most parents DON"T. That is why sex education is taught in school. If parents would leave their personal prejudices - and religion - out of the discussion, get over their own personal inhibitions, home information would be fine....but that doesn't happen either.
Sex education is important for a child - learning about Jesus and the story of Adam and Eve isn't. Religious instruction or reference has no place in a public school...we don't live in a theocratic society. Let the parents teach their child about their religion in their own home...not in my kids school.
And, you show your ignorance of the sex education lesson plans by your reference to certain sexual acts that you say are taught. Perhaps you should pick up a textbook that is used and find out what they teach instead of having a knee-jerk reaction to something you are afraid to speak of.

Okay, first of all, I am not sure you are correctly stating what this judge supposedly actually ordered as far as teaching about homosexuality. If in fact it encompasses any part of the nice words you used to describe it (which, by the way, could be taken to mean heterosexual relations as well) then I am in agreement with you. As far as I am aware, teaching any kind of "how to" classes at all, regardless of the sexual orientation is prohibited at present.
However, I doubt this is the case, as much as it is probably aimed at teaching about the different types of sexuality and, most importantly, TOLERANCE. It is aimed at teaching children another way we are different, and that it is not okay to treat someone horribly or differently just because of it. How many gays and lesbians haev been targets of slander, slurrs and outright hate crimes? And for what? Just because of their sexuality? Love thy neighbor, the Bible says. So how Christian is it to hate these people and do nasty things to them, which have included murder supposedly in the name of your God or other beliefs?
The only way to stop it is by educating people, and although elementary school may be a little young to start, they still need to hear how they are different from others, and that that is okay. I know a lot of gay and lesbian people, and none are harmful. I have had basic discussions with my kids about it, but their innocent minds don't really grasp the sexuality end of it; just that this person has a girlfriend or boyfriend instead of the opposite.

I agree because I bet that most kids that graduate elementary school already know those things and don't need to be taught them. By the time you go to high school, you would basically know everything about it.

There are too many liberal bleeding hearts out there! I'd say that the parents should fight this all the way. Along with not saying the pledge of allegiance, teaching evolution, (which is only an overrated theory). I often wonder what the hell our society is coming to!
