Renting & Real Estate - July 2007

We just moved into a new house and when we did the place was filthy - walls dirty, carpets muddy, cobwebs everywhere. We were told it would be clean before we moved in. Also, when we viewed the property I specifically asked if a big under-stairs storage area had damp, and the agent said no. However, on moving in, it is so damp the door is actually rotten (and because of this, very difficult to open) and whenever you touch the walls paint comes away on your hand.

We have thus had to spend lots of time on cleaning and decorating, and buy additional storage (it's a furnished flat) and I have not had time to work all week (I am freelance).

My mother reckons we are within our rights to ask for two weeks rent free to make up for the time and money we have spent on this, and I wondered what our prospects were.

Has anyone ever done this?
Does anyone work for a property management company?
Any Advice?

How do I approach him? When someone's on his property he freaks out and he has a zillion signs that says no trespassing. But he's always putting stuff on my property and it bugs me alot...

He's an older man...I'm just 24.

I recently moved out of state from Denver to Seattle. After a month of move out, previous apartment guys have sent us a notice to pay $1250 for damages. When we left the apartment, we cleaned it up except couple of stains on the carpet and few pin holes. We stayed in the apartment for 2 years. Now we are being charged for carpet replacement ($550) which was already old when we moved in and many misc. charges like floor replacement etc. When we were there, they started changing floors for all newly vacated apartments but why we are being charged for their plan of work. Should the normal wear-&-tear happen when you live for 2 years? There are numerous complain about the apartment in the past (checked apartmentratings.com) about move-out fines. We are going crazy, didn't face this situation in the past (in last 4 apartments we lived, in fact we got the deposit back). How should we handle this situation? Should we talk to lawyers or consumer forums. Any help or idea would be appreciated.

I recently had a bad experience with a realtor that has a pretty good reputation but totally failed me and left me eating the cost of an extra inspection and the seller walking away with more than we had agreed because she failed to tell me that could happen. I guess she gets commission off the total sale price of the house so it wasn't in her best interest to tell me that could happen. I am wanting to post my experience with her and don't know which is the best medium of leaving feedback on realtors in TN. Anyone?

This is the first time I am selling a home. I just happend to be telling my mom this morning that I'm planning on taking my $100 shower head with me when I move and replacing it with this $20 one I found. But my mom flipped and said I can't do that and I could get sued. She told me to leave it there because the buyers have seen it and are expecting it to be there. I don't see the big deal. What do you think?

Why aren't banks really eager to sell all those foreclosed properties they have? I mean, they aren't MAKING money by keeping them. We're trying to buy this bank owned home, but the bank is giving us such a hard time.

I have been working with an real estate agent for a couple of weeks. She is not as good as I hoped, but OK. The problem is that I can see her effort to push me to sign a contract. She gives much more positives than negatives on almost all properties. While the home market is not clear, she always insists that the local market will definitely boom, which I don't agree on.

I thought about switching to another realtor, but would feel guilty to do so as she has already invested at least 10 hours on my search. I know in this state, most realtors require the buyer sign the agreement at the beginning, but still some won't do that until they are ready to help the buyer make an offer. I am leaning to sign the offer with her. But ..., if she is getting worse, do I have options to switch agents beforel the agreement expire in 6 months? The agreement is not clear on that at all.

My boyfriend and I have been renting a house since the first of April. The house had some work that needed to be done on it. It needed to have the guttering put back on after they had to take it off after fixing a part of the roof last summer, there are 3 windows with small holes in them, and there's some water damage in one of the rooms. Our landlord assured us the problems would've been taken care of immediately, but it's now 3 months later, and he refuses to return our calls or anything. We signed a contract for a year, and I know the landlord could charge us for the remaining months, which would be several thousand dollars, but don't we have reason to break the contract? We're looking at buying a house, but i don't want to owe him any money. The house isn't in good condition, and it's not due to anything we've done to it, but we're paying for all utilities, and there are holes in the windows!!

I just got an offer for some acreage I've been holding for several years. Probably will accept the offer, but I want to make sure I'm getting enough $$$$ per acre. I *do* know the housing and real estate boom is on its way down, as the market in this area is flooded with houses.

This month, July, I paid the rent on the 2nd partly because the 1st was a Sunday. I received a note from the owner on Monday morning telling me to pay a late fee charge of $30.00
He has given me a notice to pay the late fee in three days or he will start the eviction process. I checked with my bank and he has already deposited the rental check. Is he entitled to the late fee in California and could he evict me for not paying the late fee?

Would my credit be effected if I don't pay the late fee or I am evicted?
