If you were to pay a landlord a deposit with the intention of moving into an apartment, but then back out, and the landlord then rents out the apartment to someone else, can the landlord legally keep the deposit or must it be returned? This is a NY issue.

I am stuck in a bad situation with a choice to make. I am tring to buy a fixer upper. I have already moved in and I am paying rent untill we close. However my loan officer is now telling me that my monthly payment will be $400.00 more than we discussed. I have invested about $4000.00 into the property thus far that I will get back at closing. However I don't think the house is worth the addition money. Here are my choices I can either move say goodbye to my four grand and rent a bigger house in better shape for less or I can stay and pay the extra $400.00 a month. Which would you do?????

I know the default answer of getting 20% equity. My question actually refers to getting Wells Fargo to adjust the value of your home. My house was under valued when I closed the loan and home values have been going up in my area. However, Wells Fargo does not really give much help on the subject of reappraisals for your home. In fact I think they like PMI. Does anyone have experience dealing with Wells Fargo on this issue? Or perhaps does anyone know if Wells Fargo is required to allow the reappraisal or what rights I may have on this issue?

In essence, my contract is a BACK UP contingency. Both contracts were contingent on purchasers selling their homes. My clients have decided to move closer to their parents in Oneonta and want to cancel their contingency contract. Do they lose their earnest money if they withdraw now? I had a real estate attorney who told me he didn't think a company could take more than 1 earnest money check on a house? Does anybody know... I can't find anything to that effect in the License Law book.

I live in VA and I'm curious to find out if there is a maximum amount that a landlord can charge to clean, paint, shampoo carpets once a resident exits the property. Or can they charge any amount they deem necessary?

My ex and I bought a "Historic" house out here in AZ a year ago in a neighborhood that isn't in the safest of neighborhoods, actually it's gotten worse. We have gotten a divorce and we want to sell the house because neither of us want it now. We've contacted many buyers like "We buy ugly houses" and others like it, but they won't touch it. Is there anything we can do to get rid of it without taking a huge hit in the wallet?

Hey there everyone. Here's my story. In September of last year, I bought a small, two bedroom house. In December, my girlfriend got pregnant. We both think we need a bigger house. I'm thinking about renting out my house, for just over what my mortgage payment is. I've never done anything like this and was wondering if it would even be worth the headache and hassle of trying to find a good renter, making sure they take care of my house, etc. Do any of you rent out houses?
