the charge is vehicular homicide. my dad was driving, and his sister in-law passed away, now the state of Ohio is charging him Vehicular Homicide. We got the county prosecutor as our lawyer to represent us.

The point of the death sentence is to punish them for their crime, right? So then why are they simply given a shot and put to sleep forever, or left in a cell with comfy treatment (that costs millions!) and alive?

Shouldn't they have to feel the same pain as their victims; you know, an eye for an eye.

Seriously, why are level 3 sex offenders living next door to some of us? I mean , I know the reality that there are sex offenders out there that aren't ever caught. But what fear do they have really? You'll get a few years and parole? Drive drunk 3x and get 20yrs!?!

I hired an attorney in another state to represent me in a misdemeanor (trespassing) case. I've never met him, but he seemed to have solid credentials and he has a huge Web site. I mailed him a check for $1,000 as a retainer. Since then, he has done little if anything. The court clerk Web page says the case is still open. When I call his office, I never get to talk to him, only his paralegal, who usually sounds confused about my case and sometimes not even familiar with who I am. This has been dragging on for ONE YEAR. I already paid him, so I don't want to hire another lawyer, and I don't wan't to threaten to report him, since I don't want it to get even more unpleasant between us. But how do I impress upon the lawyer that I am impatient and very unhappy with the lack of movement on the case? (It would be good to hear from some lawyers on this one.)

Prior to 2004, a fence could only be built if it were 30 feet in from the property line in our area. Several fences were built on the property line during this time without permission. In 2004, the code was changed to allow a fence to be placed 12 feet in from the property line. Considering the fact that the fences were against code when they were built and they are still against the current code, are the fences considered "grandfathered" simply because the code was changed?

At least that's what I heard. A guy is injured, gets a lawyer to sue the company responsible for him getting injured, and whatever he gets, the lawyer gets half for defending him. I guess I could see maybe 25%, but not half !

I should have added (first time user) that I just had a civil case thrown out of court in Arizona. The Plaintiff's counsel filed a motion to dismiss stating my complaint failed to state a claim for which relief can be granted. My attorney filed a response trying to convert the motion to dismiss to a summary judgement.

The judge agreed that no claim for relief was stated in the complaint and that my attorney couldn't rely on simply attaching an exhibit to his response to convert the motion to dismiss to a motion for summary judgement. He needed to include facts to support his request.

I am going to file a complaint with the Bar against him but I don't know what a complaint really should look like since I've never sued anyone before. That's why I'm asking.

This was on the news last night .... This sick asshole kidnapped a 12 year old from her front yard on July 4, raped her, murdered her and then dropped her off near her home. He had kept her until yesterday. Not only that, he's an illegal from Taiwan and he's a level 1 sex offender who didn't register with the local p.d. when he arrived in town.

How can having a semi private hospital room not be in violation of HIPPA?
When your doctor makes rounds, they speak to you regarding your care with another patient and perhaps their family present, when the nurse gives your meds,etc.In a semi private room, you don't have alot of prvacy, hence the name "semi private". I have worked as a nurse in some small hospitals and have even had other patients ask me about "so and so's " status which I cannot legally divulge, but if you are in a room with another patient, how can you not hear everything? Do any other healthcare workers wonder about this ? Does anyone have any legal knowledge about this?

Well i was at the hospital a while ago. (i have diabetes) and was at a regular check up when i recieved a text message of an unknown number saying "I hope you die you fat f**k" then preceded to get more texts when i started to question this person. I have since found out who it was and i feel a strong need to get them back...big style. I dont want to resort to violence as thats not in my nature but im tempted lol. As you can tell it upset me slightly its not everyday that i get messages like that and i have never had a problem with this person before. Some of my friends approcahed him and his excuse was that "it was funny, a laugh" anyone got any ideas.
