It depends on the country. Each country's laws define treason differently. For example, treason in the US requires taking up arms against the government, or providing material support to people who have taken up arms (i.e. as an accomplice).

However, the laws in Britain are different, since there are separate charges for Treason against the Crown, compared to Treason against the civilian govt (parliament).

But generally, just hoping for or wanting the govt to be overthrown is not enough. Even advocating it (using legal means) is not enough. It requires an over act in furtherance of the use of unlawful violence.

I believe that it is their choice however if they try it and get caught in the act with the evidence against them then yes I would say they should do time for it but not treason.

It's extremely difficult to apply to Western philosophies to Eastern countries.
