If it can be proved that the murder was racially motivated, there are usually two trials.
The first is the criminal trial at the State level
The second is a civil rights trial at the Federal level.
Usually the state and Feds have an agreement that whichever of the sentences is heavier will take precedence, especially if the defendant is acquitted or convicted of a lesser charge in one trial but convicted in the other.

I believe that when someone is killed purely due to race with no other motive they are charged with a hate crime which is many times worse than the same punishment if the two people were of the same race. Personally however I believe that since everyone is equal Hate Crimes should be outdated and be treated as normal crimes. The law against Hate Crimes only promotes the bad theory that people of different races are different and therefore is actually contributing to racism.

Everyone says that race doesn't matter is a hypocrite.
If the judicial system gives different sentences for crimes based on race, then THEY are discriminating on the basis of race.

The same thing that happens when someone kills someone (someone else, that is - I assume you're not talking suicide) for any other pre-meditated reason: the someone who did the killing should be investigated, arrested, charged, tried, and, if found guilty, sentenced, and executed.

Someone who kills someone else should be punished. I don't care if it's because of their race, sexual preference, or because they pushed in front of them in the line at 7-11.

Murder is murder. If they kill because of race, kill to steal drugs or kill cause they got road rage. It is all murder. A racist who murders because they don't like someone because of race is not anymore inherently evil than someone who murders causes they want your wallet.

Hate crimes are as bad as you can get, the book should be thrown at the guilty party, life without parol is not too stiff a punishment for such ignorance!

I think murder is a heinous crime, regardless the circumstances. I'm not sure I buy the whole 'hate crime' thing, and I'm gay.
