Stopped at a Sobriety Check Point, asked how my evening was and that the officer stated he smelled Majirauna, either give it to me or I will search the car. I gave him about a quarter ounce. I was not smoking in the vehicle and it was 2 hours since the smoking. I was not given a PAS, because I was not drinking and just a ticket for possession.

Is this an invasion of the 4 ammendment?? Does the officer have the right to search a person that smells like marijuana, without seeing the act?

caught a few days ago and our court date isnt until next month. I am extremly ashamed of what we did. But what I'm wondering is what will happen when we go to court? Ive never been in trouble before this is my first offense ,also what i took was less than $100 and I really have no idea what to expect when I go to court. I was reading some other questions on here about shoplifting and I read somewhere that I could ask the prosecutor to "continue without a finding" basically meaning that we make an agreement never to steal again and stick to that agreement over a specific time period that they could let this go and remove it from my record...does anyone know if that is true? what are some other possible outcomes, would it be better to get a lawyer? I know i will have to pay for the merchandise that i took, and a possible fine on top of that, i go to school full time and therefore i do not work so can i ask to do community service instead of paying a fine? any info. is appreciated. thanks

My now ex bf claimed he filed a harassment report on me. The story in a nutshell..when i was w/ him, he mentally abused me, he made constant threats of suicide, only wanted my help, whenever I told him to get prof help, he said he would do it. He lied to me about having a baby w/a one night stand, after helping him,he ended our relationship to be with the mother, I found this out while in the hospital sick and having to have surgery.Ironically, I had to get therapy. Because come to find out he is not who he says he is. I found out more lies, how he met girls in chatrooms, he did the suicide thing to another girl, but she was smart enough to call the police and he told them she was went crazy over thier breakup. Anyhow, I feel I had a right to know who I really was dealing with for two years, I feel he playedmind games withme. So I did my own research and all the lies came to surface. I got so angry I called him and told him I knew everything as far as what he's all about.

per, "People v. Welch (1999) C. 976 P. 2d 754; "A defendant does not have the right to present a defense of "His/Her" own choosing, but merely the right to an adequate and competent defense"". This brings up the fact that if a defendsnt can't present their facts of the case, then who is deciding the Truth, and What is presented to the Jury. Americans are naive to believe that the facts are presented to the Jury, they need to be aware that the only facts presented are the facts decided by those, whom are determining the defendants guilty, "Slightly Prejudicial and Bias".

this was caught on tape, but i had spoken with the guy who said he will not press charges, yet the police will be veiwing the tape for an earlier incident which occurred, can the police themselves charge me for this?

i wrote this letter a year ago. i didnt put any date on it but i wrote a very nasty letter tellin him how i felt about everything...i had just found out he cheated on me, i couldnt go anywhere around the campus becuz he would follow me and wen i went a told my dean instead of going up to him tellin him myself he denied everything and his mom called me threating me wit the letter, now i cant even throw a picture of him away without he threating me. what should i do??? can i get in trouble for writting that nasty letter that i wrote a year ago???

I was caught in 1998 shoplifting some CD's at a record store in NY, when I was 18. I live in MD and was visiting a friend in NY. I was arrested and spent the night in jail. The next day I went to court, and was charged w/ a theft under $300(misdemeanor), my sentence was 24 hrs. community service. When i got out of court I took the train back to MD, cause my family was waiting for me. I have since never returned to NY. After all these years, I was wondering what my status is. I have been pulled over for traffic violations and nothing popped up. A couple of times I have had a background check performed, and It has shown up, but nothing has been said to me. Does anyone know what my status??

I was assaulted outside of my home 2 different times by the same person. And two other times by her friends. The police haven't done anything about it and won't until I end up dead. Can't carry pepperspray in my town, so what can I do on a limited budget?

cops refuse to let me make report crimminels. refuse to let me go to the station refuse to answer letters refuse to let me phone unles i have only an emergency. when i call a cop in another county that cop well conect phone call to this city cop station who well say i have said i have said that i did not want a cop to come to my house to make any report, & for me to walk to that station to make the rep[ort. when i have never said that.ever. almost to that cop station door i well be confrunted by a cop saying that if i phone the media back about the cops i well be arrested.then when i get in the cop station the cops refuse to talk till all wittnesses that are there trying to do what thay have to do with the cops there are gone. then the cops tell me to go to another station to atempt to report a crime (that crime i was trying to get reported was of another cop that committed a crime on me in the courthouse also when i was being told to leave the courthouse (thieft) )lots of cop thiefts

It seems to me that an unmarked police car stands out much more than a police car with the lights, siren, and all of the departmental insignias all over the vehicle. Does anyone really believe that these cars blend in?

Please serious answers. I feel I am dealing with one and am fed up as to how far he can go with all he has done. Also, how could this all stand in court. If I have to go to court because of him. I exposed him and now, he has claims he has filed a complaint against me. Advise please. I know....no contact anymore. But what I want to know is how someone like this works. He has done enough damage and I will not let him walk over me again.

coward to answer the phone and confront me. I found out he lied to me and found out little by little the truth about all his lies. Today, I found out the worst one. I called him and his voice mail answered so I left him a message that his act was up and I found out the truth about him and what he is all about. Well, I got an email, telling me he filed a harassment report against me to my city police dept. He lives in NY. I live in another state. First may he be lieing? Can he file a complaint with my police dept. Shouldnt he have to file one in his own city?Also, he said he called it in..I dodon't you have to file a complaint in person? I cant believe this coward has sunk this low. I know you must be saying let it go, but he put me thru much mental abuse that I cant do anything about.
