I actually couldn't find this info on Google for once. Can you please explain to me what it means to have a "good faith basis" for a lawsuit and how one meets the burden of proving they have a "good faith basis" for a lawsuit? I'm trying to learn more about a candidate's idea for tort reform.

My father in law passed away in June. He was not married and my husband is an only child. He did not have a will. We are being told that we need a document stating that my husband is the Administer of the Estate in order to open an account in the name of "the Estate of.......", and to transfer the title/registration on his truck into my husband's name. Another possible issue is that he lived/died in California and we live in Kentucky. We called the probate court in CA and were told we needed a lawyer. Is there any way to get this document without an attorney and/or going to CA to court? Thanks in advance.

I requested from the manager clarification of the terms of lease renewal and cancellation. However, she only provided me with a copy of the terms of cancellation when I requested clarification. She verbally explained the terms of renewal but did show me or direct me to the portion of the agreement dealing with renewal. Now, a month later, I'm finding that I was supposed to give 60 days notice if I am not to renew my lease. Had the manager referred me to these terms when I requested clarification earlier, I would have been aware and sent in my letter of nonrenewal. I feel that her selective information sharing mislead me (it's a 15-page contract with 6-pt font stating the renewal agreement).

My friend was assaulted by his ex-partner but won't go to the police about it. We are trying to convince him to at least get something put on record if he doesn't want to press charges. Is there anything we can do to get the assault noted?

Does anyone know about the law passed that: "If your a Black Belt in a Martial Art, and you get into a fight, you can be sued for Excessive Force."?

(I'm not sure if it was Schwarzenegger who passed it or not.)

I read a story in the IndyStar today about a Woman who was found with a large sum of money in her car. I have heard that it is a Federal offense to carry more than $10,000 in cash. Does anyone know if this is true, or what law/code applies to this law? I wanted to research it more, but I have had no luck in finding out more. Thanks!

We recently got a new branch manager, back in april.. this man is a workplace bully, we have been forced to endure abusive language, e.g. (**** off, your ******, I dont have to do ******* jack **** mate in relation to OH&S Issues) deliberate disregard of OH&S Issues, forced to work overtime, threatened chances for promotion, threats that we will be sacked and out the gate singing for our supper, and threatened with physical violence by this man. After writing letters through what was thought to be the appropriate channels, nothing had been done to stop this. I also stated in these letters I was now on medication due to workplace related stress etc.. This man is also a liar, which can be exposed by presenting video evidence. This man knows I wrote letters about him and went out of his way to Persecute, Harass, Bully, Victimise, and Discriminate against me. I was just fired & I firmly believe his actions constitute violations of the company's policies and procedures, what should I do?

Many states have exemptions to allow parents to not have their children vaccinated on the grounds that it conflicts with their religion, and many religions do have legitimate objections to having children vaccinated, or against other forms of medical treatment. However what are your opinions on the growing number of parents who are claiming this exemption solely to avoid having their children vaccinated due to concerns that have nothing to do with religion. For example that vaccinations increase the chances of autism, that they may cause their children to get sick, or they frankly just don't believe they have any effect good or bad.
Are these people selfish, by putting themselves, their children and society at risk for outbreaks of diseases that vaccinations have for the most part erradicated? Or are these people exercising their legitimate rights to freedom of choice and the freedom from an overly intrusive government?

I have an idea of an item I want to make, which includes electrical devices. I am not an electrician or one who knows computers, but I wish to work with a company who most likely can build it. What should I do, get a patent first, even though I dont know what will make the machine work or should I wait until the company finishes my idea to get it patent. See when you send in a patent they want a drawing design of it and identifying each and every piece that explains the piece and its use.

I am a Christian as most people who have seen my answers know,
but I can take God out of the argument and STILL have a solid argument AGAINST this one.

Ok, so for one and this is VERY important,
it is ILLEGAL that means AGAINST THE LAW for kids this age to be having sex, the age of consent differs in different states but in most it is either 16 or 18 and I think in Kentucky it MIGHT be 14, but I'm not sure.
IN MAIN THE LEGAL AGE OF CONSENT IS 16 NO MIDDLE SCHOOL PERSON IS 16 (unless they were held back an awful lot , but the majority)

So if it is ILLEGAL(AGAINST THE LAW) for people of this age to consent to having sex then it should be (and I'm sure it is) ILLEGAL (AGAINST THE LAW) to give them birth control to keep them from having babies (a natural thing caused ONLY by having sex- and once in the bible by God himself)

Is it pointless for me to go to law school if I have a criminal record? I have faith that I can get into law school, but if I will never be able to pass the ethics board to get into the bar, then going to law school is moot. I live in Ohio, and am looking to go into school in Fall 08. It has been 7 years since my misdomeanor offense. Can anyonbe give me info on the Ohio Bar?

I'm a 16 year old, who has always been independent. My father has been in jail for many years now, and my mother has never been there 4 me. As a young child, I was placed in foster care, and was released to a godparent. Probably months after my release, i was given back 2 my mother. My mom have 7 kids, and it has been hard 2 take care of all of us financially; so she sent me to live with my aunt.
I've lived with my aunt for 5 1/2 years, and our relationship wasn't 2 healthy. I ran away when i was 11 to find my mom, which I did. Living with my mom wasn't the best thing either. I had to much freedom, and I got away with alot. We had constant fights, which placed me on the PINS petition. From that moment I lived with all kinds of ppl. I moved in with a old teacher who loves me at 13. I call her my mother and she has a daughter who is now 19 -n- in college, who i consider a sister. Can she get legal guardianship or is she 2 young? I want to move with her 4 school in FL.

It says in the artical that not taking a vac shot is not making a choice for yourself but instead a choice for the person sitting next to you. I find this statement to be totaly incorrect. If I choose to take a shot or not and then you choose to sit next to me puts the ball in your court. If you really care to know if people are vaccinated or not you could simply just ask everyone you meet if they are before sitting next to them... Not that anyone would do this but the point is the choice of a parent for the child they care for should not be forced simply because its also a choice that has an effect on other people... I would love to hear at what point im wrong here. I mean sure you can make the point that if people dont get vacs then they could be a risk to someone else but honestly is that how you would want to see other people as a risk to yourself and others? Does anyone actualy fully understand how these vacs are effecting our children or ourselfs? I think not...

I'm in Alberta, Canada and have worked for 2 years at my job. Now all of a sudden they sent out a letter saying we cannot be employed outside of our f/t job. Can they do this. I have had a pt job for quite sometime and it doesnt affect my ft job. Is there anything I can do. I dont want to sign this contract until I know for sure, as they say having a pt job during or outside work is c ause for termination. Thanks

I understand the rich, and rich talk show hosts being against the plan because they don't want to pay more taxes but with today's American system:

- why is a lawyer, CEO, or high paid employee entitled to more health care than a teacher, firefighter, or store clerk?

- why shouldn't a person with a pre-existing condition be entitled to health care? It's not a person's fault if he/she gets sick and needs extended care.

- why does a person have to lose their home, or all their life's work if they lose their jobs, and suddenly develop medical problems.

- isn't health insurance payments the same as a tax? And a for profit insurance company's objective is to maximize their profits and minimize costs. They don't work in your best interests.

- what good is the health care system if it selectively excludes poorer or "less-insured" legal taxpayers. Illegal immigrants, of course, shouldn't be covered since they have their own health care system back home.

I got suspended today from my job for sending an email to a co-worker. The email simply stated that no one likes you why don't you quit. I sent that email on my own time from my own personal computer. The email recipient contacted Human Resources and Security and they investigated and dug deep to find me. They found me. Said it took her a week longer to find me due to my using a proxy server.

My question....How can I be suspended and possibly fired for such a email? An email that I did at home, my time, my computer. I just don't understand it. Nothing threatening or anything like that. No one likes this person. Please tell me what i should do at this point? I'm suspended until further investigation. I can't be on the property or anything. All of this for an email that read " No one likes you. Why don't you quit?" Please advise.
