My college professor was talking about homocide and how theres different degrees to murder depending on if it was planned, or done with passion, or just a mistake....i have a question.....For the case of a couple, if the wife was caught cheating on her husband, and the husband walked in on them, and he killed the man that his wife was cheating on him with with a licensed gun,due to anger, is there an exception, like because he was angry due to this circumstance he was put in? or a different degree, and how much jail time does he get? Will the court consider this circumstance?

If the guy says that he thought his wife was being raped, would that change things? since it was toward protecting her?

If this would be in New York State and he had no past criminal history

If a child gets sick and dies because their parent chose to go with faith healing instead of taking the child to the doctor, should the parent be held liable for injury, illness and death that may be caused as a result of those beliefs?

In other words, if someone chooses to rely on faith that a deity will heal their children, and the child is harmed or dies due to the parents reliance on faith (rather than medical help), should the parent then become legally accountable for their inaction and neglect to seek proper care for their child?

Basically what happened is why fiance' made a deal with someone that he would trade this kid his laptop and $200 for a car. Well the kid did not have the title yet, nor did my fiance have the money but they wanted the deal to go through fast so basically they traded the laptop for the car, signed a bill of sale, and made the agreement that once the kid got the title in the mail, they would trade that and the $200.

Well first of all the car did not run and the kid would not let us try and fix it in his yard where the car was parked so we had to tow it to a nearby parking lot and get it to run. Well we did, but it did not run strong enough and my fiance' had no where to keep it and work on it, so he had to sell it. He made a deal with another friend saying you can have it now, give me $200 when you get it, I will buy the title from seller #1 and hold it until you can give me another $600.

what are the chances that a 15 yr. old in the state of MINNESOTA can have thier boyfriends mother take coustody of them because their getting neglect and would need to be in a better home and that home would be with her boyfreinds mom. Do you think the juge would go with that or say no and put them with someone eles and make thier life more horrible by putting them with someone they dont know and thier no confortable with. Becuase if a juge wouldnt put them with the boyfriends mother they wouldnt want to make a mistake and try and file for someone eles to get coustody of them if they get place someone eles. I just need some answer

A divorce or dissolution without a lawyer? we have been separated for 4 yrs., no kids, and no possesions to split up. I have had a hard time coming up with money to pay for it and even legal aid wanted $375. I heard there was a way you could do it yourself and only pay filing fees. does anyone know anything about this or who I could talk to to find out?

When i finally got my hands on my incident report from my DUI arrest, the description of events was worded completely different and in way more harsh sounding terms than what was described on the pink slip arrest warrant court appearance paper i was given including a difference in order of events. Should the 2 documents and their description of incident not be pretty similar. It just seems like they were telling the strory differently to me on the document they provided me with then they were going to tell court with the arrest/incident report that I had to go get on my own days later. I dont know if this right or wrong, just looking for someone who might know or has experience with this. The two documents should have been filled out at or around the same time during all the process at the police station and it seems the descriptions would appear the same. Any insight will be helpfull and appreciated.

Can a cook refuse to cook a meal for there boss and expect not to get a warning?
A cook that works for me refused to cook me a meal. Apparently this is not there job? Surely cooking is there job
regardless of who its for? Can someone please tell me, Is there some law somewhere that states a cook that is employmed, can pick and choose who they cook for?

I recently was seen in the ER. My bill after insurance was almost $500. The hospital wouldn't settle with me to take less thank $78 a month, I told them that with other bills it would be very difficult for me to make the payments. Unfortunately 2 months later that same problem sent me to the OR, now I have another bill for over $1500 for the hospital. They wont accept me paying them even $50 a month for that bill. What can I do to protect myself? I cant afford to pay all of these bills for all services rendered. I havent even got the full bill for the OR! Is there anything protecting me? I paid my first payment of $78 but it was 6 days late d/t my finances being short and not knowing about my budget. Can anyone shed light on my situation?

I have a small claims matter on my hands and I have filled out the Summons and Complaint- Small Claims form. We are in one county and he is in another. The clerk of courts told us that the form should be filled out were the action took place, but that he would need to be serviced in his county. What does *serviced* mean and how do I go about it? Since then I have decided to no leave my position. I have tried calling our human resources department 6 times and have never gotten any reponse from them. I have tried to explain my side of the story and take back my two weeks and I have been told Im not allowed to do so by my store manager. The district manager who screamed at me now realizes she made a mistake by doing so, and would rather see me gone than apologize and let bygones be bygones. Meanwhile Im going to be out of a job that Iove. Ive never missed a day of work or have been written up for anything. Is there anything I can do?

Okay, here's the problem. I rent a storage unit, it's under MY name. Since it's pretty big, I have room for other stuff in there so I let people I know to use it as well. I let my inlaws put a BUNCH of stuff in there (took over half of the space and they only paid less than a 3rd of the rent) when they were forced to move. I also allowed a friend of mine to put 3 bags of stuff in there when he fell on hard times and his room mate got them kicked out. Then, my inlaws took all their stuff out once they got settled in a new place. My friend called and asked if he could get his stuff. I go to the storage unit, and his stuff isn't in there. I call my inlaws and they say they took it (it was all in waterproof offshore bags, so I KNOW it's his) because they thought it belonged to their son (my husband, who is currently deployed). They say they took it so the stuff (lots of software and other stuff) would not be in the heat. It's been 4 days now and they will not let..continued below

My husband and I live in Tennessee. We live in a townhouse, that we own, not rent. Our HOA is supposed to cover everything from the outside to the drywall. Recently we've noticed an infestation of Brown Recluse spiders in our home. When talking with someone about it they said that by law, the HOA is supposed to have an exterminator come on a regular basis to spray the outside premisis. Which, they do not currently do. Also, all of our doors need new weather stripping, is this their responsibilitiy? And can they be held responsible for our spider infestation? We pay $100/mo in association dues and their are no amninties, nothing and they don't even do what they are supposed to do most the time.
Anyway, sorry for the long one, But if anyone KNOWS the answer, please answer. I am trying to find out if there is any truth to this stuff before contacting a lawyer. So, if you don't know the answer but know of a website I can research it, that would be helpful.

some guy hit my husband,,,,messed up our car,,,provided false insurance information, he got a ticket from the police, his car was impounded. now,, when we wanted to get our car outa the lot, we called and called him to take care of the problem,,,he never returned the phone calls,,,,we had to pay out of our pocket,,,,now my question is this....the car he was driving was his mothers,,and she has a policy on the car,,,,now their insurance is claiming he was excluded from the policy,,meaning their insurance wont pay for anything,,,is that possible??? it was her car,,,,,can we sue her??? i just want whats fair,,,somebody needs to pay,,,,,

Your girlfriend is a bit crazy, she shouts at you then physically attacks you. You head for the door, she prevents you from leaving. She continues hitting you. You use sufficient force to remove her from you way and run for your life, to find yourself getting arrested for assaulting a woman. The mere fact that you touched her makes you guilty, and no court wants to hear the facts. So what are you supposed to do? bear in mind that some of these attacks from her have been so serious that she has actually stabbed me in the leg, a wound which took three days to close up, and i couldn't walk for 6 weeks.
Ok we are not together anymore, but seriously, legally, does a man have any right to defend himself against a violent woman?
