What if they say that the price is firm? For the Atlanta market do I have leverage to still offer a percentage of the asking price on bank owned (foreclosed) properties. Would I still have a chance to get a binding contract on it? I am speaking in general terms.

The seller owes $14,000 in back HOA fees and I do not trust them to pay up before we close. I don't want to end up stuck with this lien. Can I withdraw my purchase agreement? And if so what is the penalty for doing this? State of California, escrow account, scheduled to close December 4.

My house has been on the market for about 3 weeks. First off, when he came by, he kinda made me feel like my house was crappy, and it aint. But the main thing that is bothering me is that I haven't heard anything. I guess nobody has contacted him that they want to see my house, but still, should I at least receive a call from him just to let me know he's trying? He has not made any calls whatsoever. I was just wondering if this was normal or not. By the way, he's been in the business for over 30 years. Is there a specific website to check on complaints of realtors in Texas.

Is there anyway to legally break our lease? We are renting a beautiful home in a beautiful area. The landlord is great, no mantainence issues, the only problem is that we just found our dream home, and would like to buy it now while it is on the market. Any suggestions?
Fyi - Our landlord will is great however not reasonable.

Last February we bought our first home. The home was listed with a new roof and well pump. At inspection these things came back good and we went ahead and bought the house. A few days later our insurance agents come out to do a final apraisal or what ever, they noticed a few shingels were missing, and we went ahead and called some one to fix them. While the guy was up there he noticed we were missing the tar paper under the shingels, and that the shingels were old and damaged. So obviously, not a new roof. I called our agent who was not helpful, and has been avoiding me since. So I called the seller who informed me, that there was never a new roof. I then called her agent from Vigna, who wouldn't even take my calls. Now it's November, and our well pump just died. I talked to the local guy, and was told the old owners never replaced the pump, he knows because he did the work. They just rigged it to work. It's obvious we were lied to, is there any thing we can do?

We recently received a letter from our landlord services indicating that they bankcrupce filling by our ex-tenants was disimissed indicating that we had the right to retry to collect from them. This should clear the way for us to collect almost 10 k they owe us in back rent due and legal fees.

How do we go about that? I heard something about putting a lien on their salary.

Question:

Does the court do that for us automatically since we won the case against them in court? or do we have to hire someone and try to collect? This occured in Modesto California.

I am under contract to have a new home constructed by a builder. The bank has just appraised the land and new home construction project too low to be willing to give the loan. This despite stellar credit, no debt, and a 20% down payment. The builder has agreed to pay for a second appraisal. What should I look for to ensure that the builder did NOT shop for a builder friendly appraisal rather than an honest, independent one? In other words, what should I look out for? Any advice?

I purchased a landlock property at a tax sale. Unable to sell it do to the land lock I have tried to gain access from the other landowner. He won't budge and is maintaining his land lock in the hopes the property will default back to tax sale. Can anyone help me break the lock so I can use or sell my land?

The contract with my realtor expired, instead of extending the contract, I decided to try selling the home myself. A month later, I ran into a friend who I happened to know had looked at the house previously during an open house. He and his wife said they were still interested, and asked if I would consider a Land Contract.

After we came to an agreed upon selling price, I had another realtor draw up a land contract agreement for a $500 fee.

Now, the previous relator is suing me for her commision on the sale of the home because she initially showed the property to the party. The 60 day period as stated in my contract had not expired before I signed the Land Contract. Am I correct to assume that she should not receive a commision until closing since this is a land contract??? She wants the entire amount of the commission immediately.
