And it was never mentioned in my mortgage,now i have minerals that can be exstracted,i feel that if i want to sell my mineral rights,lease them,transfer them to a family member it shouldnt have anything to do with my mortgage company that loaned money to me to be the owner of my house and property.im just playing with this but say a "ficus"tree somehow grows on my property which might increase its value,would my mortgage company have say if i wanted to cut it down or sell it.....

In a situation where the borrower is current with the mortgage and has good credit, but knows that they will have problems in the future with payments. Where the property is worth less than current loan amounts. The owner wishes to get rid of the property.
This is the primary residence, but they have someplace to move to. My question is, which is preferred by the loan company? Which will clean up more quickly in terms of credit score, Deed in Lieu of Foreclosure or Short Sale?

Facts to consider:
It's in Orleans Parish.
It's gutted out and abandoned damaged 52% by Katrina.
Taxes not paid since 2004.
Owner not likely to redeem.
I paid the taxes and will receive a Tax Deed in 2 weeks.
I am looking for a book or information specifically on what to do after the property is purchased. I know that I have to contact the owner. If there is a form to inform him of his rights I need that. I also want to know what improvements to the home are refundable if the owner redeems. I knwo I typed a lot, but this is my first home and I want to do this right. PLEASE, only serious responses!

With a mortgage you don't even own the house until 30 years later after you make all the principal and interest payments which means you end up paying double the original purchase price. There must be a better way than being a prisoner of the bank?

I left my appartment in near perfect condition and better than how it was when I moved in, yet I am being charged cleaning fees after I moved out because I didn't hire a proffessional cleaner. According to the apartment complex if you dont hire a cleaner yourself it is beyond normal wear and tear. This doesn't sound legal to me. Does anyone know what the phrase means under the law?

I don't know much about mortgages so I was wondering if you get foreclosed, whatever that means. I guess it's when the bank demands the entire loan for nonpayments. Do you get what you paid so far back on the house and lose the house? Doesn't sound so bad to me, just buy another house. What's the fuss?

does a private landlord have the right to enter his property without asking the tenants permission beforehand while the tenant is out?

The apartment I live in has a terrible trash situation. The dumpsters are placed so you can't get to one of them, and there is always trash piled around the other. The piles get huge, and sometimes it's impossible to place trash IN the dumpster.
I always try to get it in anyway--usually I THROW it in. Last week it was too heavy to throw, though, and I put it on the heap with all the rest of the trash.
The manager went through my trash bag, found my address in it, and is now threatening to fine me. I live in Texas--is it LEGAL for them to go through my trash? If so, do I have any recourse, short of joining a tenant's association, whose fee I can't afford?

So we closed on a house 2 days ago but can't legally move in yet becauses the $3000 dollars we were supposed to get from the SELLER at closing somehow ended up in some damn escrow account. They were trying to steal money that wasn't theirs! They though it was repairs that had to be done in order for the house to sell. They told us to go hire someone to fix the house and send them the receipts. And our agent just sat there like an idiot and didn't say anything. That money was the offer we put in to the seller that he agreed to. The agent should have spoken up, she's the one who wrote the offer after all. So we actually threatened to walk away from this deal. Only then did everybody run to the phone and try to do something. So they said the check that was supposed to be there at closing would be here the next day. That was Wednesday it is now Friday. Yesterday their excuse was they could not wire us 2 checks in the same day (we were also waiting for his $500 dollars back

My husband and I live in an apartment complex where parking has always been somewhat of an issue. He left last night at about 8:30pm to get a pack of cigarettes at the gas station across the street. When he came back his parking spot was gone and there was nowhere to park. He drove around the complex twice and there wasn't a single spot to park. He ended up parking on the curb which is a fire lane. We have parked here and so have others and have never been towed. This morning when he was leaving for work his truck was gone and it turns out it was towed. So now he has to pay the towing fee. The complex has told tenants that there are enough spots for two vehicles per apartment. Are apartment complexes required to have sufficient parking for tenants? What can I do about this? Is there anyone I can contact to report this?

as i'm making some researchs on the escrow account applications in real estate market, i'd like to know:
is there is any idea of how can a real estae developer keep a part of the purchase outside the escrow account?
for example: can the developer make a membership card (used one time) allows the purchaser to get a 10% discount of the purchase price, while the actual price of the card will be more than this as the card gives the purchaser other benifits (free nights in hotels, ruffle on a car, ...)...
also if you have any other ideas plz explain them.

I am a Realtor and was wondering if it is legal to assist people obtain a Forberance Agreement, Loan Modification, Partial Claim...in order to avoid a Foreclosure and get paid upfront fees for doing so?....The fees are reembursed if nothing gets approved...would these services be legal? The housing market has fallen considerable. I live in one of the highest cost of living areas in the country. I have seen home prices fall from $50,000-$100.000 within a few months.

However, I'm not quite ready to buy. I might be in a year or so. Will the housing market still be a buyers market then? Will home prices go even lower then what they currently are?

I purchased my first condo on my own and have found it to be a less than great experience. Currently I'm faced with being upside down in my loan (due to the market) and all the units around me have been vacant for a long time (some years)

It also appears that the HOA has lost all interest in keeping the community clean and in proper order. So its possible that I'm faced with losses even after (or if) the market ever comes back up.

I've spoken with some financial advisors about my options and among the options; one was to sell/give the property back to the bank. I have good credit and have never been late on a payment.

I've searched and searched and can't seem to come across much information on this process, has anyone ever heard of this? and what might the consequences be if i were to go through with it?

Any information would be greatly appreciated.
