Two illegal aliens have agreed to a $100,000 out-of-court settlement after threatening a multimillion-dollar civil rights lawsuit against a Texas deputy over an incident in which the lawman shot at an alien-smuggling vehicle he said tried to run him down.
Maricela Rodriguez-Garcia and Candido Garcia-Perez, Mexican nationals who were being smuggled into the U.S. in April 2005 when they were injured by fragments of the lawman's bullets, agreed to the amount after a mediation hearing in Austin, Texas. They initially asked for $1.5 million.
Mrs. Rodriguez-Garcia, struck by bullet fragments in the cheek and mouth, and Mr. Garcia-Perez, injured when fragments hit him in the arm, had targeted Edwards County, Texas, Deputy Sheriff Guillermo F. Hernandez, saying he used excessive force in causing the injuries and that in firing at the vehicle abused his authority and grossly overreacted under the circumstances.
Hernandez has been sentenced to prison in the incident.
Edwards County Sheriff Donald G. Letsinger, who also was targeted in the pending lawsuit, said his deputy was cleared in an initial investigation by the Texas Rangers, which found that Hernandez "followed the letter of the law" in defending himself. He said charges were brought only after the matter was turned over to the FBI and to U.S. Attorney Johnny Sutton, who last year also won convictions against two U.S. Border Patrol agents who shot a drug-smuggling suspect as he fled back into Mexico.
"This is very bothersome to me," Sheriff Letsinger told The Washington Times. "Whether it's a U.S. citizen or a Mexican national, I just don't think the taxpayers should have to pay someone who broke the law and, in this case, someone who committed a crime by illegally trying to enter the United States.
"It's not any different than paying off a bank robber who happens to get shot on his way out of the bank," he said. "In this case, the two conspired to break the law and when they got caught tried to run down my deputy."
Hernandez, 25, was sentenced March 19 by U.S. District Judge Robert T. Dawson in federal court in Del Rio, Texas, to one year and one day in prison and ordered to pay $5,347 in damages to Mrs. Rodriguez-Garcia. The judge also ordered three years of supervised probation and an additional $5,000 fine.
He was convicted on charges of violating "under the color of law" the civil rights of Mrs. Rodriguez-Garcia during the Rocksprings traffic stop.
Hernandez told investigators that the driver of the vehicle tried to run him down after he stopped him shortly before midnight for running a red light. As he approached on foot, he said, he spotted at least eight persons lying down inside the vehicle. He said he fired shots at its rear tires as it sped off after trying to run him down.
Mrs. Rodriguez-Garcia and Mr. Garcia-Perez told investigators they paid $2,000 each to be taken across the Rio Grande from Acuna, Mexico. They said they later met the vehicle's driver and a guide, who were to take them to Austin and Dallas.
The $100,000 settlement figure was recommended by the West Texas Rural Counties Association, an insurance pool that will pay the amount. Sheriff Letsinger said attorneys for the association concluded it would have cost at least that much to respond to a lawsuit in court.
The settlement agreement also included a promise from the two Mexican nationals that they would not pursue any further litigation against the deputy, the sheriff or Edwards County.
Sheriff Letsinger said Hernandez does not plan to appeal the conviction, saying "he just doesn't trust the system anymore and I'm sure you understand why."
They tried to kill the deputy by running him over, that is not in dispute. They wanted to kill him cause he was in thier way, what makes you think they would not try to kill you too if you happened to be in their way?
Last I heard it is the Sherff's job to protect the community that elected him. Allowing murderious criminals to run loose is not my idea of protecting the community.

Ok so here is my story tell me what you think! I usually have a 27 day cycle but my periods have been coming closer together and very light. I was due for one yesterday, but it didn't happen. I feel very bloated and have wierd cravings (hot fudge and pickles). I took a pregnancy test well two of them and both came back negitive... but it was wierd where the plus was supposed to cross the negitive. the ink didn't bleed through. this happened on both tests. so it was like a dashed line. I cry for no reason and my doggie won't leave my side. When my fiancee comes near my stomach he trys to bite him. I don't know what is going on or even if I should think anything of it. Im almost 18 so going to the doctor without my parents finding out is kinda hard. So is there a secret to knowing if you are pregnant without using a test or going to the doctor.

When I inhale or take deep breaths it hurts my lungs, and not like the muscle around it, it feels like the actual lung itself.
I am also kinda short of breath. I have a slight cough. I first got this pain yesterday and now my neck, my shoulders and my back hurts. I don't smoke, I don't drink, I don't do any drugs, and I don't do anything that could risk my health. The only way I can describe the pain, is that it feels that when I take a deep breath some one is like squeezeing my lungs. I am 15 and I am not to concerned about it because I have had it before and I went to the doctor and he said it was a sinus infection, and that was the same pain in my lungs that I am having now. Do you think it is a sinus infection, a lung infection, pneumonia, bronchitis, pleurisy, or something else. And if you could I would like to know some ways to help it. And please don't say visit the doctor, because if it doesn't go away, I am going to go to the doctor. Thank you all for your answers and time

I do volunteer work and give to charity. My reasons vary from wanting to help someone, to setting a good example for my son, to paying it forward, to just plain old fashioned guilt. Are the receivers of the "guilt"charity worse off than the receivers of the "wanting to help someone" charity?

As a Roman Catholic, I know all the church's & religious reasons given why a priest is supposed to be celebate, i.e. to be married to God & the faith etc. but I find it incredible that this still remains the rule. My opinion is that is unnatural and cruel to expect a man to sacrafice companionship, love and physical relationships with another human being in order to serve God. Loving another human being surely does not restrict a man's capability to love and serve God? What kind of person then does the church appeal to? Someone who does not need a healthy loving relationship in their life? Is this why there is so much peadophilia discovered within priests? If God is all loving, why would he be so selfish as to demand that a man willing to serve him, be exclusive to Him only? Why would God not want his loyal servant to be rewarded with the joy of having a family and experiencing the love of a partner or children.Surely there is no greater thing in this life than to love and be loved.

I'm considering taking the ol' kayak out tomorrow on the IRL (Indian River Lagoon, for you non-Space-Coasters... Eastern Central Florida), and I've been asking this around a lot, just seeing what feedback I can get from all you lovely people. I like to just toss a lure behind me and give it a bunch of line while I'm paddling along. Typically I'll rig a gulp shrimp weedless and let it do it's thing, but does anyone have any other suggestions for a good brackish-water "trolling" lure for a kayak? Any and all suggestions are welcome, and if I have the wherewithal to try your suggestion, I'll let you know how it works... that is of course -if- you get an answer in before I leave tomorrow.... otherwise you get to wait till next time I go out.

Thanks!

Being a Christian is ignorance. To believe in something you can't see or touch is ignorant, even if it gives you comfort. What I hear from most Atheists... "If you are a Christian then you are closeminded and prejudice." Totally different from most "open-minded and accepting" Atheists.

Anyone else as proud of their "ignorance" as I am??
