If there are talking animals, it is fiction.
If there are dead people who are doing anything other than decomposing, it is fiction.
If there are magical or supernatural events, it is fiction.
If there are imaginary places that no one has seen or that no one can give you the precise location of, it is fiction.
If books or movies contain any of the above elements, they are not to be taken seriously.
If someone presents them to you as factual, they are liars or they themselves have been deceived by liars.
Books may contain speculation, conjecture and even hypotheses without being fiction. If the book contains any of the elements previously mentioned, they are not conjecture, but fiction.
