Isn't that a function of the Judicial branch of government? And isn't there a "separation of powers" issue involved?

From what I've read, the police have the authority to arrest you and take you immediately before a magistrate, but they have no authority to issue a judicial "Notice to Appear".

My husband is adamant that as of 1/1/07 it is an OFFICIAL LAW that you cannot drive and talk on your cell phone in California unless you are using a handsfree device like a Bluetooth or headphones. I understand that driving with a phone is unsafe, but I still think it's not illegal....at least not yet. Can anyone tell me?

Have heard that they must have their park lights on and have heard they can sit in the dark. Seems to me it would be unsafe to sit parked along the interstate after dark with your lights out.

I went to the St. Louis Arch the other day, and had a small pocket knife I carry with me almost everywhere. I saw a sign that said no weapons could enter the Arch, so I hid the knife in a small cabinet by the front door where they have literature about the Arch. When I left, I went to look and found no knife. It was no big deal, so I'm leaving and I'm telling my little brother it's not there when I'm approached by one of the security guys there. He overheard me and I was honest and told him what happened, so he gives me a federal citation for 'Abandonment of Property'. They never saw or found the knife, all they know is I said I did it. The security guy was being a jerk and treating me like a criminal that was leaving grenades around or something, and was obviously on a power trip and needed excitement. Now I can pay $125 or go to court, I plan to go to court but can anybody give me any advice on this? How to fight it? Anybody had this problem before? Thanks

according to an article I've read, flashing amber lights at pedestrian crosswalks mean that vehicular traffic can proceed with caution and does not necessarily mean for a car to fully stop.
However, I don't know if it applies to california.

do they have cameras installed by the pedestrian crosswalks where amber lights are flashing?

Do you go to jail for being held in contempt or is it more like a fine and then community service?

how long does a car have to stop when the amber lights at pedestrian crosswalks start to flash?
if the pedestrians are already out of your way and are about 5-6 steps away from the sidestreet, is it legal to go?

Just wondering, because about a month ago this kid from high school came up to me and told me he was now an officer. The real messed up part, is that this kid is not sane. He was the "weird" stalker kid that always chased girls around kind of like a 3rd grader in the halls. I know he never went to college and I don't even know if he graduated from high school. What does this say about the selection process of becoming a cop. It doesn't seem right to me. Got retards running the streets...

I mean in the way they use words:
they call a fine: "bail"
if they are talking about denying you at the border they say you will be "extradited" and if you show up and check in when agreed, they say you were "deported"

does lack of respect for language flow from their lack of respect for the law?
