I am seeking to have a child custody case transferred from an L.A. County Family Law court to another state. The Commissioner (judge) in L.A. refuses to cede jurisdiction to the other state, but Uniform Child Custody should take precedence over the judge's refusal to transfer the jurisdiction. What are my options? The child and myself have now been official residents of the other state for one year.

Suggestions wanted. The wife claims that American law enforcement processes are so biased against people of color that justice is impossible. She refuses to suggest what to do about it other than to accept at face value even accusations such as the recently disproved claims against the Duke University lacrosse players. [She's defending the actions of the now dis-barred District Attorney.]

My counter position is that in the case in question, the government in the person of the District Attorney ignored both the lack of facts and (a month later) exonerating evidence. I'm supporting giving judges the authority to over-rule prosecutors and juries when they've clearly ignored the evidence or decided in opposition to the evidence.

Ok ... does she have a point? If so, what actions or reorganizations of law enforcement can be implemented so that "justice", both individual and collective, will prevail?

GL ... you'll need some thinking on this one.

The recent bill which was passed in the house, but is set for veto by GWB,(http://www.yahoo.com/s/608546), aimed to ease restrictions on federal funding for stem cell research. It also outlined a policy for which stem cells could be obtained, stored, and usage....whereas, they would have to be harvested from embryo's that would have been otherwise discarded anyway, and with the donor's consent. This is where I do not understand the argument against stem cell harvesting. Procedures such as invetro-fertilization, which is very common, produces hundreds of embryo's which are subsequently destroyed. These are the very embryo's that scientists want to use.

My question is.....if they are going to be destroyed in the bio-medical waste container anyway....why shouldn't they be used to help find cures for diseases and possibly save thousands of lives ?

Where is George W. Bush's logic on this ? We all get that he is pro-life, but I have yet to hear a valid argument on stem cell issues.

I was fired whilst still in probationary period. Reasons given were bad attitude towards my team & non communication to my line manager. I refuted this & have spoken to my team since being fired, with several members saying they would happily argue that this was not the case.

The letter given to me on the day states "further to our meeting" yet all points were obviously written prior to it.

No previous opportunity was given to discuss any of the points.

On three prior occasions I had requested a review with my line manager to improve communication and had provided, in writing, my available dates but had no reply.

I had also highlighted to my line manager that I had not been provided with any clear targets or goals.

I was very succesful in my role, however, and took sales from £200/day to £6,500/ day over the 4 weeks.

I feel my line manager who conducted the meeting saw me as a threat and conducted a witch hunt agaist my better character.
What are my rights please?

While at the babysitters, my ds (6yr) had a squabble w/ another child 10 yrs old. (as children tend to do, one wants to continue playing and the other says no.)
They had been playing with this child's laptop for the pior 3 days sharring fine. My ds commented he wanted a 'Webkins',
apparently they were going on-line.* (I figured it was a childs PC and the babysitter seemed ok w/ it.) I was under the impression it was a child's type toy Until day 4 when it was damaged, it was a "$3,000 toshiba widescreen laptop". (Why would the parent allow a child to bring an expensive toy to share w/other children in the 1st place.. )
Why wasn't sitter in room oversee activities of children (if online?) so disagreement did not "escalate to the point of my son's hand getting crushed against screen & keyboard?" Plastic screen crinkle that causes a black dark line when turned on - but still works.
Any suggestions on how I should proceed am I obligated?
What is are responsiblity?

My credit card was stolen over the weekend and used by a thief to create a Paypal account, which he in turned used to purchase some auto equipment. Interestingly, the auto equipment turned up on my door step today and I called the company listed on the invoice. They verified that the order had been placed and told me that there had been a problem with the order initially, because the thief wanted the items sent to an address other than mine. The company refused to share that particular address with me.

This is not the only fraudulent charge placed on my card by the thief (my credit card company is aware of the situation and the account has been closed), but the auto parts company is the only company that allowed merchandise to be sent out, even though red flags indicating that the card was stolen went up. Can I sue this company for allowing this? Can I report them to their credit card processor? Can I sue them for not giving me the initial delivery address?

Is it Constitutional that Mr. Bush vetoes it for the second time (probably but almost for sure) I mean:

If it has been already accepted through the Congress and it has widespread public support, then why Mr. Bush vetoes it?

Is there a jurisdictional way to get out of this?

She lives in Virginia, if that helps, and I'm looking for any laws, statutes, or policies which would guarantee her right to an education -- her family will not support her, or her baby, so she may be forced to find somewhere else to live with the child. She is worried about her schooling, for obvious reasons.
There may not be anyone to care for baby when she is at school; could she be kicked out if she brought baby with her? The school does not have a daycare service. Are there any laws in the area which support her? Does the government offer any type of assistance for teen mothers who are still in school? [daycare, specifically]
Well, you can see the dilemma; any advice or information offered is greatly appreciated. Thanks in advance.

I filed a response to my ex-wifes Petition for the Out-of-State Registration of Child Custody/ Visitation and Petition Affecting Parent-Child Relationship. I filed it with both courts and just received a note from the court where I reside that they decided to file it as a Petition not a Response. I'm not sure what this changes. Is it for jurisdiction reasons? I'm having trouble researching this.
Thank you in advance

I am 16 and will be 17 in Oct. and my boyfriend is 20 and will be 21 in Jan., i told my phyciatrist that we were having
sex and she said she might have to report this. Is this true? I thought therapists and counselors had confidentiality. Will she break this? I have told other counselors and the local health center and they haven't had to say anything. I thought they only have to report when you are going to hurt someone, when someone is going to hurt you or your going to hurt yourself. I your not sure or don't know then please don't answer and please no stupid comments.

I have an aunt how is in the hospital she's is coming around now, but before, she was unconsicous for about a week. Her husband visited on the first few days, but now isn't visiting at all. My grandma (her mother) is getting there everyday even though it is an hour away from where we live. My family keeps trying to get him to visit (she is asking where he is) but they are worried that he may tell them not to give us any info about her. Would he be able to do this even though it has been my grandmother signing consent forms and going up there everyday?

there is no scientific evidence suggesting significant risk of negative deffects as a result of mating. Also supposing the psuedoscientific belief that it causes deffects were true, and the couple was gay or used condoms then what excuse would their be?
it is a felony in many states.

PS: this is not in regards to incest between children so don't play the "its to protect the children" card.
