I am 16 and will be 17 in Oct. and my boyfriend is 20 and will be 21 in Jan., i told my phyciatrist that we were having
sex and she said she might have to report this. Is this true? I thought therapists and counselors had confidentiality. Will she break this? I have told other counselors and the local health center and they haven't had to say anything. I thought they only have to report when you are going to hurt someone, when someone is going to hurt you or your going to hurt yourself. I your not sure or don't know then please don't answer and please no stupid comments.

Also she didn't tell me until after I answered her that she might report, she gave no warning.

She is neither required nor permitted to report it. She would be mandated to report if a child under 14 were having sex with someone 14 or older, or if someone under 16 were having sex with someone 21 or older. She's not required to report a 16-year-old having sex with someone of any age, even if it's considered statutory rape. Since she's not required to report it, it's protected by doctor-patient priviledge and it would be illegal for her to report it without your consent.

It depends on your state. Some states require them to report it if they discover a crime is being comitted. Some states do not REQUIRE it, but she is allowed to.

SO yea, she can report is, and it is possible she may be legally bound by law to report it.

This section of law states that there is no psychotherapist patient privilege if the patient is under the age of sixteen, and the psychotherapist has reasonable cause to believe that the minor has been the victim of a crime and the psychotherapist has reasonable cause to believe that disclosure would be in the best interests of the minor. This exception to the privilege is analogous to that provided under Section 1024 of the Evidence Code (patient dangerous to self or others). Even though these sections of law appear amidst the statutes governing psychotherapist-patient privilege, dealing with in-court disclosures, they do appear to apply to situations that may occur during the course of therapy, when no court proceeding is pending.

As with conjoint and family therapy, it is important for the therapist to fully explain his/her policies regarding confidentiality to the parents of minors who are in treatment with parental consent as well as to the minor. While being sensitive to the legitimate concerns of interested parents, the therapist must also be cognizant of the minor's need to believe that his/her conversations will be treated as confidential. Without this belief, minors may be untrusting and this can hinder successful treatment. The minor must also understand, if possible, that the help and support of the parents is often influential in the overall success of the treatment. Talking about these issues with the parents and the child prior to treatment can save a lot of headaches later.

Therapists are required by law in most states to report crimes, particularly if it involves a minor. While it may seem silly to some of us, sex between a 20-year old and a 16-year old is a felony (statutory rape.) Unfortunately, doctor-patient priviledge doesn't cover this under the law.

Therapists are mandated reporters when it comes to child abuse. Having sex with a minor is considered child abuse. If she does report it, chances are nothing will happen, but there is always the possibility that your boyfriend could get in trouble for statutory rape.

Technically they have to report anything wich violates the law or could potentially hurt somebody.

In your case both apply.

Your boyfriend is breaking the law by having sex with you, and by law - that hurts you.

it is illegal for her to make a report. she's a therapist, not a news caster or radio reporter. she just want you to always comeback to her again for advice so she can charge you over and over. slap her stupid face with a hammer! just kidding...

You are a minor and your boyfriend is an adult and in this day and age that is a crime on your boyfriend's part ...it's called child sexual abuse.
