Assume that I am in a game website playing a game, then I noticed a pornography web advertisement besides the game. May I know whether it is illegal when I visited a website with pornography web advertisement?

(Please take note that the advertisement may change each time you go to this webpage or website again) May I know whether it is illegal when I visited a website with pornography web advertisement?

Browsing or visiting a Pornographic website is not a crime in India. For this let me state the relevant provisions of the of Information & Technology Act, 2000 which is section 67 states Publishing of information which is obscene in electronic form. - Whoever publishes or transmits or causes to be published in the electronic form, any material which is lascivious or appeal to the prurient interest or if its effect is such as to tend to deprave and corrupt persons who are likely, having regard to all relevant circumstances, to read, see or hear the matter contained or embodied in it, shall be punished on first conviction with imprisonment of either description for a term which may extend to five years and with fine which may extend to one lakh rupees and in the event of a second or subsequent conviction with imprisonment of either description for a term which may extend to ten years and also with fine which may extend to two lakh rupees. What is important here is either such an obscenity is being published or transmitted or caused to be published in the electronic form. Here neither you are publishing or developing or making any obscene/p o r n website in the electronic form nor you are causing it to be published or made or developed in the electronic form nor are you transmitting or sending it to anyone through this electronic media. All adult or p o r n website you browse or visit are already published & being transmitted world wide through internet/web so you are not covered under this provision of the IT Act, 2000. So go ahead visit any such site you like but be careful about two things firstly these sites are warehouse of computer virus, adware, spyware & Trojans that can spoil your whole system, secondly whatever you download in your computer system don't transmit that content to anyone not known to you or even if known to you such person may not use it against you for getting you punished under this very provision of the Act for transmitting obscene contents.

If it is the advertisement, it's the problem of the webmasters to check if it is legal or illegal...

In fact sometimes, by mistake you end up in clicking it or when you click close, the button is actually meant to open the site. That is how such sites are designed. It is forcible intrusion into your PC by the porn sites.

So, it is not illegal. Just have the safe search on so that these sites do not appear even while playing games.

Well, it provides you with something nice to look at while you're playing games. =)

And remember, almost all of the people who play internet games are male, so it's a great way for these companies to advertise.



Enjoy pornography while it lasts! It won't be around forever!
