Of course he wants you to settle, a quick few thousand for him, he doesn't have to go to court. and you get to suffer for the rest of your life, AND get to pay all the medical bills!

Get another lawyer!

Alfred, please don't listen to the previous answers because they're foolish.

If you fire your lawyer, you may be responsible to pay him reasonable attorneys fees for the work he has already performed. It may come from you, and it may come from the insurance company if they agree or lose in trial and are ordered to pay your attorneys fees. However, I doubt that they will be ordered to pay it or agree to pay.

Your suspicion of your lawyer's loyalty is not warranted in this case. What is more likely the case is that he wants a fast settlement. What I know is that you have several herniated discs. Was this your first accident? If you have prior herniated discs, you should probably take the settlement. Do you have any tears/ruptures/splits or nerve damage? If not, you're not really looking at much. Then, there is your age to consider, your state laws, etc. It's complicated.

If you have one herniated disc and some inflammation, then 10k sounds about right. However, I'd hold out for 15k because you'll have to pay your lawyer 30-33%.
