I would like to ask whether there needs to be a pre-existing legal relationship (contractual or otherwise) in order to apply the doctrine of estoppel, in the case of Jorden v Money.

At the moment it seems that it is given as a gift to the cronies of the rich and powerful. Surely in order to attract the best talents, it should be a competitive process. Further, do you think Mr P. Wolfowitz is the right man to lead the World Bank's fight against corruption? Or will it have the effect of allowing crooked presidents and leaders to laugh, 'Sha ha ha ha!' all the way to the bank?

Paparazzi takes your picture and sells it to the newspaper and then your on the front page. Why is this possible when others whom take your picture or record you (even if your just in the background) for like a TV show or something then they need you to sign a release? This does not make sense to me. Could someone explain all this for me please?
Thanks

Last Friday morning I rear-ended what was probably a stopped vehicle on an interstate highway. It was dark, I crested a hill and didn't see the vehicle until it was too late to stop or swerve around him.

After the accident the vehicle I hit left the scene and I never found out who he was. My vehicle was most likely totalled, but I was completely uninjured. My airbags didn't even deploy.

I was disoriented for a few minutes, but called 9-1-1, my wife and my insurance company in that order on my cell phone. I'm glad to be okay, and I've been putting things together and I think I was pretty much aware of what was going on prior to the accident and was basically in the right.

The driver I hit was likely intoxicated, or engaged in illegal activity, or uninsured, or an illegal alien or all of the above.

Have you had an experience like this? Share your experiences with any accidents you might have had. I hope we can all learn from them.

I just started a new job at a grocery retailer (my first day was Sunday.. Mother's Day). On top of a few things that I can work through (like being thrown into chaos with absolutely no training, working 8.5 hours with only 2-10 minute breaks... (which, is against the law where I am from) I was scheduled to be off today. I made plans to run errands, pay bills, and then have dinner with my In Laws, being that I worked through Mother's Day, and wanted to take them to dinner with my husband. When I got home, around 8:30pm, there was a message from earlier in the day asking me to come into work, but if I couldn't make it, to please call, just to let them know. When I called to apologize for not getting the message earlier, the manager that answered said, "That's ok, you can come in now". I told her that wasn't possible, as I have had more then a couple of drinks and didn't think it was a good idea, she then stated "That's okay, as long as you don't smell like alcohol, no one will be here that you will get in trouble with". I told her that I don't know that I don't smell like alcohol but I was definitely not going to come to work under the influence of alcohol. She then said "No, you sound fine, you need to come to work", I told her that I was only calling to apologize for not getting the message sooner, but I will not be coming into work intoxicated. It is company policy and I had to take an alcohol/drug test to get the job. My question is this. I am a part of a union, and want to know just what I should do. I have every intension of taking this to the store director, but in the same, can they write me up for not coming in. Further more should I tell them that if they schedule me to be off, then don't call me to come in? I have a very busy life outside of work. If I have nothing planned, I don't mind giving a helping hand, but I feel as though if you schedule me off, I have a right to my life.

Any suggestions would be greatly appreciated.

I need to write a letter to a law firm and was wondering what order the address is in--which of these two is it?

(line 1) Jane Doe, Esq
(line 2) DOE & DOE, LLP
(line 3) 1234 Attorney Dr. Ste 123
(line 4) Big City, CA 12345

OR

(line 1) DOE & DOE, LLP
(line 2) Jane Doe, Esq
(line 3) 1234 Attorney Dr. Ste 123
(line 4) Big City, CA 12345

I really want this to be correct because it is for a job. Also, I want to address it to two attorneys, do I include both their names on one line or put each of their names on their own separate line?

Thanks so much for your help!

I live in Mexico and my boyfriend lives in Louisiana. I've got him a job and a place to live in Mexico and he wants to fly here and be with me. We haven't seen each other since March! He's 17 and has a passport and has graduated High School. But his mom doesn't want him to go... Then she fights with him all the time and makes him miserable... If he came anyways what would happen? Would he be arrested if they found him? Or could he fly here and once he is in Mexico be fine? Please help me! If you want anymore info please email me x_untilprovenguilty@yahoo.com.

I was told to come in and go over the job offer letter. I was offered the position, will they now decide to conduct a background check, check references and verify employment? This was not done before the offer was made, so I'm wondering if they are going to start this process now. It does not make sense to do all of this AFTER extending the offer. Or will I just accept job offer and fill out the regular paperwork to start?

I think it should ONLY be allowed if the mothers life is in danger due to the pregnancy. The mother, no matter the age or state she's in should be able to choose whether or not to have the abortion. I also think morning after pills should be allowed to be taken by a mother of any age in any state, if the pregnancy was due to rape/incest.(without a prescribtion) If the mother doesn't want to have the baby, but it isn't going to be a dangerous pregnancy the local hospital, federal goverment, etc, should take the baby. (for adoption) Finally, I think all other forms of abortion, in all states, should be strictly prohibited.

Hi,

I used to work for a tutoring company. I believe the company is violating copyright law. The company buys the standard, run-of-the-mill test prep books (such as Barron's, Kaplan, etc.), and make several copies of the same book, and distributes the copies to all their centers, rather than buying individual books for each center. Is this legal or is it a violation of copyright law?

Ages 5 - 16 my mom did whatever she wanted, left me with people, I changed schools 21 different times (no joke). From ages 16 - 21, I was raped, I drank a lot, I got my GED, had 2 kids, got my tubes tied & burnt, lived wherever I wanted. From ages 21 - 24 I had been beaten, ran into a phone poll (not drinking).
At age 24, I came to stay with my granny til my father in Tennessee could rescue us & help me out. She was in good health then. While waiting 4 him to set things up for me there, granny wrecked her car, broke her collarbone, needed 6 months to heal & I stayed. At end of the 6 mths, I get a call from dad's wife, he had shot himself & they are waiting on me to come pull his plug. I did & came back to granny. Her diabetes, congestive heart failure, arthritis & bronchitis set in. I have cared for her since. She has lost her mind, I have all but lost mine. She gets worse- they put her in a home - my kids & I will have nowhere to live. Have no car as is. Squatters rights? Legal Help?

... then why wasn't there a huge gun problem back when guns were totally unrestricted? In the first half of the 20th Century, anyone could buy guns through the mail, with no background checks, no proof of I.D., no waiting periods. Obviously, there's no connection. In fact, the opposite can easily be argued.

The ability to learn law and learn from the mistakes of others is somewhat lost when public litigation is replaced by alternative dispute resolution. Choose one of the following resolution methods, and defend why it is a good option for business: arbitration, negotiation, mediation, minitrial, or summary jury trail. Explain your reasons why sacrificing public litigation might be good for business.
