Public litigation, properly applied, is a good thing.

Public litigation, abused, is merely legalized theft.

The reasoning is simply that humans find it easier to steal resources from others than to earn them themselves.

When the other litigator is the retail customer/little guy, then biz loves ADR. Why? Because the biz is a repeat player while the consumer is not. Therefore, biz starts to develop relationships with the mediators, etc (who want the repeat business). Relationships with the mediators makes the playing field no longer level but instead favors biz.
