My husband and I are considering buying a two-family unit. The previous owners did not winterize the property properly and all the raidiators burst. Now, a new heating system would have to be put in. We're weighing our options and deciding if we would want to put a bid in. Realtor said he would suggest putting in forced air and said he guessed it would cost about $8K to put in. So now we're trying to figure out if we should put down less of a downpayment and fix the heat, or put down more and then use space heaters until we had enough money to fix the heat. We would live downstairs and rent out the upper 1 BR unit. Can we legally do this? People have told me that space heaters would work fine, but I'm leery of them. What would you suggest we do - less downpayment and fix heat or more downpayment and use space heaters?

I have read the IRS definition of "first time home buyer", and have a question. I do not own a home or pay a mortgage currently. I rent a house from my dad currently, and am also on the title for that house (used to be my grandfather's house). Does this prevent me from being a "first time home buyer" per the IRS definition of not having a "present interest in a main home for 2 years"?

Here is an email I got from Centex Homes. I also came across the same problem when i bought a home out of state 2 yrs ago.

But I want to get to the bottom of this! What law are they referring to? Is it just for out of state real estate? or does it include real estate companies in state too? does it include industries outside of real estate? I think the only states that have this law is NY and NJ, the most expensive places to live. Can anyone point for me the exact law description?

At the end of June, we purchased the house we are currently living in. When we did the walk thru, we had noticed the floors seemed a little spongy. No where in the discrepency form filled out by the current owners at that time, were there any problems listed about the floors. The realtor recommended a inspection company to come out and inspect the house fully. We agreed, and split the cost of the inspection with the sellers. We also put into the offer that in the inspection revealed more than 2,000 dollars worth of damage/repairs, we would drop the offer. After the inspection, the inspector marked the floors of the house as Acceptable. So, based on this, we closed, took posession. A few days ago, we had a company come out to look at fixing the floors.. surprise. Our house has absolutely no center beam, and the entire weight of the floors, is supported on 2by16s, spanning over 12 feet long. this is far from acceptable. What is my option, can I sue? All repairs could cost up to $30,000!

the family aknowledges that there was a verbal agreement but they refuse to honor it, they want me to sign a "rental" agreement now even tho I have been paying toward purchase all these years and I have made significant home improvements including, painting inside & out, new light fixtures, new sinks, floors, tile countertops etc. do I have a legal interest in this property and how do I exercise it? The owner always told me not to worry that everything was taken care of and that his family knew our agreement, I think they are getting ready to evict me since they also made an appointment with my 10 year old visiting grandaughter to bring in a realtor! I also received a threatening call on the 2nd that the "rent" was late, it wasn't due till the 10th with the original owner and there has been no new agreement other than the heirs demands. I need HELP!!! thanks....ph and did I mention I am poor and raising a grandchild as a single parent.

The house which they are trying to let out has got very good features,but because the agents are apparently short staffed they would allow veiwing(that too no more than 4 slots available) from 10am to 11.30am on Wednesdays!!!
The house has still not gone even after 5 weeks,and many interested clients like me are not able to view it.
Obviosuly they are not helping the vendor or the potential tenant..
Is there any way we can tackle this,or we just need to bear up??

My home has been foreclosed on but there was no successful bidder and the property went back to the mortgage company. I want to keep the home and told the mortgage company that I would be able to pay off the loan balance in three weeks if they give me the banks info that I need to complete the transaction. I know the mortgage company is not obligated to sell back to me. But what are the chances? I don't want to move out.

I am investing time ,effort ,goodwill and money in arranging a house-mortgage,in UK, in two other names of my friends.I will be responsible for maintaining,letting and generally managing the property on a long term basis and build-up a portfolio.I wish to have a legal say in all these day- to-day matters ,and also in any future decisions to operate and liquidate the portfolio to share the profits .I was advised that I can get one trust deed made and signed by all of us towards this end.Suggestions are welcome.

I have an offer accepted on a flat (UK). I have my mortgage offer, but my solicitor has not received any documents frm the vendor's solicitor. The vendor's solicitor and the estate agent are saying that they haven't received the title deeds from Northern Rock yet. It has been 5 weeks now. How long should this take - as i am getting worried that the sale won't go through. The vendor is a propoerty developer, but the flat is empty and the tenants have moved out. any advice or similar experiences?

Although the rental agreement allows me to rescind the "privilege" of paying the annual rent on a monthly basis in case of default, most judges will not award blance of year's rent attached to eviction.
AND once evicted the deadbeat tenant has no more oblication even though the landlord has to spend a lot of work and money to re-rent the apartment. If no takers for several months, the landlord is out the rent that there had been a contract to pay.

How's that fair to the landlord?
