Do you know that the Church even prior to Vatican 2 taught that their was Divine Law of the Church and Human Law of the Church. Divine Law can never be changed. Catholics are obliged to obey the Human Law but it can be changed, dispensed from etc.
For instance Law of Fast and Abstinence. Friday abstinence was never applied to Mexico.
Also mature judgement could be used. A friend who went to Mass after work got involved in her work and ate a candy bar within the time of the old 3 hour fast. She was in the Communion line when she realized she had broken the fast, but to sit back down would cause scandal and that would be more serious than worrying about the Law of Abstinence. Priest and a Bishop agreed she was correct.
If you see a person breaking their fast before communion, you are not to say anything to them.
If they go to communion unaware of breaking their fast they have done nothing wrong and the grace of the sacrament is theirs.
