Law Enforcement & Police - December 2006

I can certainly understand an emergency, sometimes an officer has to reach his or her destination quick. But it's become an epidemic. The officer follows close behind for a few, then signals me to move into the other lane. Note, the other lane is usually clear of other vehicles. He would have no problem if he chose, to cross into the next lane and cut in front. Some officers have done just that! The first few times I very innocently complied, thinking it must be an emergency! No officer would flash his lights just to avoid the inconvenience of having to move himself! He must've received an emergency call to 'protect and serve'!! I've come to realize that a lot of cops seem to believe they are above reproach on the road, that they can speed despite the speed limit and use the badge to make you move; half the time all they want is to get ahead. Funny how they slow down and turn off the lights once you've moved. Question: am I legally bound to move over for these lazy, aggravating people?

In CA I recently received a ticket for crossing the double yellow line while entering the diamond lane. I had two occupants in the car. I moved into the lane about 50 feet before I was "legally" able to enter the lane, mainly to avoid an impending accident ahead of me with several brake lights shining in my lane. I figured it was the safest move to make and any officer nearby would understand. Apparently not. He put his lights on soon after I entered the diamond lane wanting me to pull over immediately. I stayed my course because it would have been yet another fine if I crossed back out of the diamond lane when I wasnt supposed to. I waited until I was legally able to make the lane change, then proceeded to pull over. He wasnt happy.

I would like to fight this. Can anyone find some links regarding fighting diamond lane violations (and winning) and/or the various diamond lane laws just within California alone? If I did this near San Francisco, this would have been perfectly legal. TNX!

I was at a party last night and the cops entered the backyard with their flashlights etc. I don't have a problem with them breaking up the party, I'm just curious if noise problems are enough probable cause to just enter a backyard without being let in nor even trying to get in through the front.

I was not thinking and stole $130.00 shoes and was caught. I am 22 years of age, and this is my first offense. I was given a citation which they marked as a Misdemeanor. I am graduating soon from college and want to become a teacher and do not want this misdemeanor to effect my chances of getting a teaching job. Are there any other loop holes that can improve my chances or this not to go on my record and ruin my chances on getting a teaching job. And what would improve my chances as far as a 'Public Defender', or an 'Attorney.' My court date is on Jan. 22, 2007. What can i say to the judge?

Anybody know the distance you are required by law to stay back from a railroad crossing in San Diego County CA? Have you ever heard of someone getting a ticket for this? Any help would be appreciated. Happy Holidays.

Okay I received a ticket for leaving the scene and failure to yield. Let me tell you what happened I was going to make a left turn and got hit in the rear knocking me in to the nexy lane where a car hit me. The driver that hit me from the rear got a ticket also. After getting hit I moved my car off the road thus getting a ticket for leaving the scene ( I was still on the scene ). The cop was older and was very abrasive I thought he was racist because he started screaming at me and handcuffed me at the scene. Another officer made him release me. Going to court I was pulled out of line by the court officer put in line with about 10 others, all our tickets were dismissed, The judge apologized to me and the others that received tickets from this officer. The court officer said that the officer that gave me the ticket did this often. I am really glad that I got off, but wondered what happens to officers that are known for giving erroneous tickets.

I have received a DUI in Wichita Kansas in July of 2006, went to court for the first time but the charges had not been filed yet. It is my first time ever and I have the diversion papers, but they will not let me file them until I am charged. They are supposed to let me know when that happens, but as of now I have not heard. I do not want to draw attention to it if they are just sitting on it but then again I would like to know what I am looking at as far as cost and classes. How can I find out about that or get some idea as to what will happen next? I cannot afford an attorney and do not feel it will be advantageous to me to try to get one as I know I was in the wrong. I just dont like being left out in the cold.

Several years ago (8-9) I got a DUI in NJ when I lived there. I have since moved to PA and recently got another DUI in NJ. This time it was under my PA license with my new PA address. The cop told me if my first DUI was within 10 years I will be charged with a 2nd offense. If I never turned in my NJ license will my previous offense show up? If so, how do they know I am the same person if I still have my NJ license?
