I helped my friend file a temporary injunction a few days ago? Does anyone know what the process is, after filing? We tried calling the courts to find out but the Judicial Assistant is out of office and won't be back for another two weeks. In the meantime, we received a call from the clerk of the courts with a case number and the judge's name.

When should we expect our case to be addressed by the judge? How long does the opposing side have to file a response?

Many Thanks

This happens the most at the local level. When it comes to alot of things. Approval of tasers, internet filters at libraries, crackdowns on headshops that sell tobacco pipes, crackdowns on porn shops, crackdowns on strip clubs etc. It is sad that it should have to move up to a federal or state court for some of these ordinances to be declared unconstitutional. Be wary of local politics sometimes. Civil liberties are important.

My fiancee just deceased. We have been together for 14 years. Out of our relationship we had accumulated property, cars, etc. He was not working at the time. I filed bankruptcy because I lost my job. I won my case and a lumpsome of money. I gave him so much money and the property had to be in his name, because of his good credit.
Now since he has deceased, his family is coming after everything I paid for. I have receipts that I gave him money for cars, property and etc, it wasn't a gift. Do I have any rights?

my sister is executrix of my mothers estate. How do i know what were all of my mothers assets? She has sold the house and sent me a personal check for half of the house. My brother in law has rights of survivorship for mutual funds my mother and he shared. I understand i would not succeed in contesting but do i have the right to know what they are? There are more financial accounts however my sister says that they are not part of the estate. She says my mother wrote a letter to her dictating what was to be in the estate.....the will itself is vague. Shouldn't i have a copy of this letter?

An attorney bought our 65 year old home last year and then threatened to sue us if we didn't pay him $1,000 because there was a trickle of water in the basement. We did not disclose any water problems because we didn't have any in the 3 years we owned the house. We ignored the letters on his company letterhead and he filed suit against us for $2,000 plus his attorney fees even though he was representing himself. We felt coerced into settling with him (for $1,500) because hiring an attorney would have cost us more than the settlement and we felt he would have the upper hand in court if we defended ourselves.

This just doesn't seem ethical to me that he could utilize the power of his firm to basically blackmail us into paying him.

What is our recourse?

Is it considered a crime, if a mother harms her child while she is still carrying it. I.E. Drinking, doing drugs, smoking, fighting, too much physical activity? I understand if someone else harms the mother while she is pregnant and it has a effect on the unborn child, then it is a double crime. Can a mother be prosecuted for harming her child?

OK I sell comics on ebay. I recently sold one for $400. I mailed the item out insured mail but when the buyer recieved it it had been water damaged. He turned it into the post office for the insurance and they asked that I send them the original insurance ticket to process the claim which i did. He then filed a claim through paypals for another refund through them. Any suggestion on what I should do from here? It looks like he will get a refund from paypals as well as from the post office. I know paypals says he will have to return the comic but he could easily swap the high dollar comic out with a junk one and I would have no proof. Is there anyway to prevent this? If I get a package from him should I take it to the local police dept unopened or maybe the post office and try for mail fraud charges? Any help would be appreaciated.

Should parents be notified if underage child asks her doctor for an abortion?

Regarding Prop 85 in California. This is simply to notify parents if child asks for abortion. Parents don't have to approve but simply be notified.

There are 3 protections in place for at risk kids.

1. If court feels child is in danger at home then can waive parental notice
2. If court feels child is mature enough then can waive parental notice
3. If medically necessary then can do at that moment without notification.

So if your 13 year old gets preg and wants abortion shouldn't you know about it?

Focus on the word "harm," and all of it's subjectivity.

In response to:

"I Could argue that any question on YA breaks one or more of the "rules." Can you?
YOU MAY NOT POST CONTENT (or links to content, including photos):
a. to exploit, solicit, or harm minors."...

I received:

" S t, a question that's honestly asking for information does not break any of the rules you singled out. I'm not sure how section (a) can be ambiguous..." Quote from Jane Y!A Staff.

I am currently pregnant and married. My husband is out of the picture and was before i got pregnant. I am sure the child is not his. I want anyones advice as to wait and get a divorce after the child is born or before. I have contacted the courthouse and they said either way he would have to ask and pay for a paternity test. I dont want anything from him except a divorce. I had found out though after he left he had been cheating on me and continued after he left. This makes things a definite divorce i dont want and try to work things out its been almost a year since we have even talked. I need thoughts on what to do
