OK I sell comics on ebay. I recently sold one for $400. I mailed the item out insured mail but when the buyer recieved it it had been water damaged. He turned it into the post office for the insurance and they asked that I send them the original insurance ticket to process the claim which i did. He then filed a claim through paypals for another refund through them. Any suggestion on what I should do from here? It looks like he will get a refund from paypals as well as from the post office. I know paypals says he will have to return the comic but he could easily swap the high dollar comic out with a junk one and I would have no proof. Is there anyway to prevent this? If I get a package from him should I take it to the local police dept unopened or maybe the post office and try for mail fraud charges? Any help would be appreaciated.

If you bought the insurance, it was your insurance to collect, not his. He should get his money back through paypal, you get the comic back and you get paid for it from the insurance. You should not have sent him the original form. You may be out of luck, but try contacting the post office and ask for advice on how to proceed.

I would definitely get in touch with the Postmaster at your post office and go from there. Make sure that PayPal (owned by EBay, of course) gets totally involved and that communicate the problem between them. USPS hates paying insurance claims!

The United States Postal Inspector's service will be willing to get involved in this as you went through their service. www.USPS.gov. Even without the insurance ticket, they will check for fraud. Remember, all post offices now have cameras that monitor all the stations. They then have DVR's recording everything that goes on. If the inspector suspects fraud was commited, he will do a through investigation. He may also if he wishes get pay pal records to confirm your story.

Report the event to paypal. Advise of a possible scam. I would even call paypal immediatley. If you advise them of a possible scam, and that the post office is reimbursing, they may not give a refund. Call Paypal ASAP!

my experience is that w/ ebay and paypal the scammers always get away w/ it...the best thing you could do according to ebay is become paypal verified and only sell to people who are the same...this way ebay will cover the cost above like a small 30 dollar amount...other than that get a merchant account and set it up that way other than the ebay/paypal payment method...you will save money from ebay charges and merchant accounts might handle matters like this better..I've seen alot of people sell on ebay and ask that a customer would pay through their merchant account link i.e. mastercard, visa.....gl...

I think what you should of done was have him return it. Then you file the claim at the PO and then refund his money. However, since you have the money and he's handling the insurance, I'd just stay out of it.

You can contact the post office, but I am not sure it is against the law to get all refunds you qualify for

I would tell somebody at PayPal and at the post office. Once you've told them all that you know, you're off the hook.
