My brother Jimmie is an 18 year old high school senior who works at McDonald's to save money for college. A few days ago, he was leaving work and accidently backed into a coworker's '94 Ford Ranger. My brother drives an '05 Grand Am. There was a minor dent in Jimmie's bumper and a minor dent in the coworker's door. Jimmie wanted to call the police, but the guy said he has 3 kids and can't afford car insurance. The guy begged my brother not to call the police and Jimmie made the mistake of not calling. They agreed that nothing further would be done. Later that evening, the guy went home and tried to fix the dent himself. When he returned the next day, the dent was twice the size it was. He then told my brother that he tried to fix the dent and couldn't, so he went and got an estimate for repair of the damages. The total was $1500. He is now harrassing my brother at work, and calling him at home.
Since the guy didn't have insurance but my brother did, who's at fault? Who pays? Thanks!!
