My brother Jimmie is an 18 year old high school senior who works at McDonald's to save money for college. A few days ago, he was leaving work and accidently backed into a coworker's '94 Ford Ranger. My brother drives an '05 Grand Am. There was a minor dent in Jimmie's bumper and a minor dent in the coworker's door. Jimmie wanted to call the police, but the guy said he has 3 kids and can't afford car insurance. The guy begged my brother not to call the police and Jimmie made the mistake of not calling. They agreed that nothing further would be done. Later that evening, the guy went home and tried to fix the dent himself. When he returned the next day, the dent was twice the size it was. He then told my brother that he tried to fix the dent and couldn't, so he went and got an estimate for repair of the damages. The total was $1500. He is now harrassing my brother at work, and calling him at home.

Since the guy didn't have insurance but my brother did, who's at fault? Who pays? Thanks!!

If the Ranger was parked, the accident is entirely your brother's fault. However, since no police report was filed, and no pictures were taken, and there were no witnesses, AND the guy obliterated the original damage, there isn't much he can now legally do to get your brother to pay.

If the guy didn't want to pursue the Insurance route, to begin with, he has to live with the consequences.

The next time the guy calls just have your brother tell him that if he calls again, your brother will call the police and file a complaint against him. And, if the guy does call again, your brother has to follow through and file that complaint.

Well, your brother was obviously at fault.

Who pays? Should have been the insurance, but since the co-worker didn't have the insurance and didn't want the police involved he decided to take that out of the equation. Your brother should not foot any bill, especially if the damage was increased by the co-workers effots. He may have caused the damage, but the co-worker chose to avoid the proper channels to save his own ***. Your brother shouldn't be penalized for that.

Also, $1500 damage for the door of a 94 Ranger? The truck is probably worth the same amount total the way it is.

I think that they will chastise brother that since they left the scene of the accident, didn't involve the police, and didn't exchange any information. Then it becomes only a matter of opinion, with little evidence to back up any body's claims. For future reference, it's probably best to call your insurance company ASAP, and get their opinion. 9 out of 10 times they will tell you to contact the police, just in case. I doubt they will hold your brother responsible for the other guys dent, though. He's likely out of luck, too. The insurance company might even be able to sue the guy since he is driving an uninsured car, so he'd be in even more trouble.

Having insurance or not having insurance has no bearing on who is at fault. Your brother backed into the co-worker so it is your brother's fault. Regardless of whether or not the co-worker was insured, your brother is responsible for the damages to his vehicle.

i would call and speak with an officer about this i think the guy with no insurance will be the one in trouble but your brother did back into him so he would be responsible if the police did come

AAA isn't refusing to tell you - they don't know. And won't know until your policy renews. No one here can tell you either, not because we refuse, we don't know you. It's up to you to go through insurance or not. I'd take the chance on an increased rate. There are too many things that can go wrong with paying privately.

The guy w/ no insureence will get his car pounded i believe

Your brother will possibly pay little fee due to he crash to the guys car. but don't know.

Your brother should turn it over to his own insurance company.
