A friend just bought a used car two weeks ago, and is now sitting on the side of the road. Can he demand a refund? Is he SOL? Does anyone know?

My husband and I have a 2000 Dodge Neon that my newphew has offered to purchase from us. He has since changed his mind 5 times since the initial interest and now he's back to wanting to purchase it again. Anyway, Kelley Blue Book value is at $5000. We have given him the offer of putting $1500 down and $400 a month until paid in full. We have chosen to not surrender keys over to him until 1) he has his license (he's still working on it) and 2) balance is paid in full. He's a bit of a flake and doesn't understand how the real world works so what type of paperwork would I need to make sure that he understands that the car is priced as is, no matter how long it takes him to pay, that the price will not fluctuate, etc. and that if he fails to pay his monthly obligations that we have recourse. I know this sounds all too harsh but his family has a history of not being good on their financial responsibilities so I just want to make sure my husband and I are covering our bases.

I found a private seller online that has a car part that i want, he is accpeting a cash offer, and wants me to wire the money to him. We both live in the same state, and he has it listed on ebay auction. I was wondering what is the safest way to make this deal without having to give him the money and not get the parts he promised. My wife purchased a new car in New York and now is ill and will not be able to drive for some time. Therefore the car is useless to her. I called the dealership about returning the car but they will not talk to me. They say that the car is in my wifes name and they will only talk to her. She currently is in the hospital and unable to talk to anyone. What can i do. She bought the car two weeks ago. I bought a 2002 Acura RSX from Legend Auto (in Dallas TX) and they told me the car had come from NJ, never been in a wreck, and it only had 40,000 mi. on it. I checked the Carfax and it was all good. I spent $14,000 on it. 3 months later my two back tires blew out. After I got new tires, the wheels couldn't be aligned because the frame was bent! I took the car to a mechanic and he said it had obviously been totaled (not so obvious to me!). So I hired a lawyer and paid him$1,000. That was a year and a half ago. He never returned my calls and his office is never open. Should I just spend the money to fix the car, or try to find another lawyer?
