My wife purchased a new car in New York and now is ill and will not be able to drive for some time. Therefore the car is useless to her. I called the dealership about returning the car but they will not talk to me. They say that the car is in my wifes name and they will only talk to her. She currently is in the hospital and unable to talk to anyone. What can i do. She bought the car two weeks ago. Is there any way i can return this car and not incur massive penatlies due to my wifes health condition. Any help would be appreciated i cannot afford these payments.

In New york as in most states the dealer is under no obligation to take a car back. It would be an enormous undertaking as the vehicle is now titled (therefore used nd value is lower), the financing is in place and technically the bank owns it. the dealer would probably be more inclined to trade you out of it into a more economical car with a payment you could afford (but you wont be getting the trade in value that you paid). I have worked in dealerships for years and although they probably dont want to tell you this but thats the way it is

Unfortunately you are stuck with the car. If she had bought the car in the past 24 hours, then there is a way of returning the car, but after that there is only one way you can return the car, and that is if it is a "lemon". Your best bet is to sell the car for what is owed or a little less and you pay the rest. I feel bad for you and your wife, as I have been in a similar situation. Post your car on Ebay with a reserve that you covers what you can handle losing, and remember that Ebay charges a percentage of the selling price. Try and sell it outright locally on Craigslist. I applaud you for being such a good man. A lesser man would just drive the car as much as possible until the repo man comes to pick it up. Katrina G. is obviously an idiot, or a child. Don't pay her any attention.

If you have already received your first bill or have been notified of who your finance company is, you have to deal with the finance company. Once they pay the dealer for the car it's out of his hands. If you bought the car recently, you can ask your wife to sign a notorized letter and have it faxed and then FedEx'd directly to the dealer. By law, they don't have to take the car back. So be extremely nice and maybe someone will have a heart.

First let me say I am sorry to hear of your wifes illness, I hope she gets well soon.
The dealer will probably not do anything. because she has entered into a contract. Unless the dealer miraculasly grows a heart, there is no backing out of a signed contract. Actuallyits the bank youmight have to deal with.

Do you have Power of Attorney? If so, car dealership has to talk to you. You have 30 days to return the car. Just show up with the car and POA. If they have to talk to her that bad, they call the hospital.

You need to get durable power of attorney, then legally you are able to handle any matters on her behalf. They should have those papers at the hospital, one will be for healthcare & the other for all other matters. As long as she is able to sign her name...you are good. Or does she already have a living will & power of attorney? Either way, thats what you need.

well thing is...the cars value decreases the moment u drive it off the car lot.....usually about 15% ....

only thing i can see doing is selling it back tothe car lot..but its risky....they wont give u back what u paid for it....unfortunetly there is a lack of compassion these days ...for people and uncontrollable events that happen....

check the contract tho....mayb there is a loophole where u have a certain amount of days where u can change yer mind....check into it a lil more ....

i hope something can be done...

No, there's no way that you can cancel the deal. Your only option is to sell it outright. Hopefully she put down a large down payment so that you owe less than the car is worth. If you owe more that it's worth, you may not even be able to sell it.
