One could argue that it is the responsibilty of the principal to provide and orderly and safe envoirnment. Although students have a right to privacy this expectation can be diminished in certain cirumstances. If the teacher has reasonable beliefs that drugs may be found on a student it is not in the schools best interest to request a warrant beforehand.

On the other hand, it is argued that if the search was conducted by police it would of been unreasonable because they did not have a warrant, therefore the evidence should be excluded. The court should decided whether they search should be conducted not a teacher since they are not fully versed with the practices of law and cannot insure and objective search. Schools have a duty to foster consititutional rights, and there is no compelling evidence that schools require a lower standard.

If a person was convicted because of this should an appeal be allowed?

My wife's grandfather was a bomber pilot in WWII. He was shot down over Italy and wounded. He never received any awards for his injuries or his heroic escape with his crew back to Allied forces. Can anyone provide any information on how he could be recommended for at least the Purple Heart that he deserves?

The government has directed the police to enforce what used to be considered very minor infringments of the law.

By criminalising whole swathes of the population, are they trying to generate evidence for bringing in even more draconian legislation to grind us under their jack boots?

At what point must society look at the crime independently of the criminal to dispense justice? Should the punishment be exactly the same for somebody with NO record as it is for somebody with a history of criminal behavior?

Or at what point must society punish the criminal for repeated offenses, regardless of the crime committed?

Is one seen as justice for society (fitting the criminal) rather than justice for the criminal (fitting the crime)?

And if the punishment must fit both, how can this be accomplished?

My youngest son (22 years old) just flew out to go to boot camp for the Marines. He will be at San Diego, California.
I can't stop crying, but I need to be calm when he calls to say he made it there fine.
I am very proud of him and have told him so. I do not want him to worry about me. I have gone to the Marines web sight for parents, but they can't really tell you things that another parent, sibling or a marine can about what to expect.
He made a wonderful asvet ? score... 90 out of 100.
He choose to be an M.P. and then try to get into intelligence after a year. He will go to Mo for the MP trainning.
That means in about 6 months he will be sent somewhere and that is the scarry part. I keep thinking about him in Iraq or Afganastan.
Would you please give me some information on what I can realisticly expect for him.
I want to be strong and proud just like him.

How can you be labelled as a soldier one day and an insurgent the next?

Would the US Supreme Court make a ruling that was not approved by the Mexican Supreme Court concerning immigration unless it was about something that was clearly illegal or non-humanitarian?
Are Mexican immigrants clearly illegal?
Do the supreme courts rule on the humanitarian level and the politicians lie, cheat and steal to get into, or stay, in office on the "parking ticket" level?

The biased media and liberals only report LTG Sanchez's negative comments regarding the Iraq War.

Does anybody agree with his comments regarding the media?

Maybe if we in the US saw REGULARLY POSTED video installments of day to day life for families in Iran, we would have a more balanced and informed view of that country. I know it's a big country with different social, political, religious populations, but it couldn't hurt to have a connection of some kind.

I looked on youtube and found nothing.

Anyone know of a non-political video diary or vlog from there? Or anyone know a family there with a video cam?

I'm contemplating challenging a charge of disorderly conduct for handing alcohol to a minor "creating a hazardous condition", by pleading not guilty and appearing before the magisterial district judge.

So what happens when I go to court? Do I just plead my case to the judge, and then he decides whether or not I have to pay it? Is that it?

My case is...

My girlfriend (the minor) only touched a bag with wine for only a second.

I really doubt the officers could have actually seen her touch it, based on where they were in relation to us as it happened.

And they were going to charge her with wanting me to get her wine and for giving me money to do so. Even though we both told them she never did when they first questioned us.

What do you think?

Then my girlfriend heard she could loose her license by pleading guilty to, possessing alcohol. And that I could possibly loose mine for challenging my charge. Could we? We only received fines and were ordered no court dates.

I had a separation from the AF with a RE Code 4c and I am trying to get into the Marine Corps. It is based on a medical as my recruiter is trying for a waiver with two recommendations from two of my doctors for a condition with no symptoms or concern for treatment(small PFO, heart). Has anybody or know anyone that has reenlisted in the same branch or another branch with a waiver for RE Code of 4c? Are my chances easier with the AF because it is less physical demanding than the Marine Corps? Please answer only if your source is valid.

According to this story from WorldNetDaily, California government schools have banned the words "Mom," "Dad," husband," and "wife." Well .. at least that's the argument from the Capitol Resource Institute, and since we're talking about California here ... they may not be too far off. All it will take now is a lawsuit or two to get things rolling. Governor Schwarzenegger signed the bill which also orders government schools to allow boys to use girls' restrooms and locker rooms and vice versa.
One of the bills signed is SB777, which ban anything that could be interpreted as negative toward homosexuality, bisexuality and alternative lifestyles. Another is AB394 which targets parents and teachers with "anti-harassment" training.
Any text, reference or teaching aid that alludes to the idea of marriage as only between a man and a woman is banned. Any materials that say that people are born as either male or female – and does not offer an 'in between' option – is officially banned. Any sources that do not include transsexual, bisexual and homosexual historical figures can no longer be used. And sex education materials must offer the option of a sex change.
Moving on, homecoming kings can no longer be limited to just males. The same goes for homecoming queens. And students can choose which restrooms and locker rooms they want to use, the restrooms that correspond to what they believe their sexual orientation to be.
This same bill will promote these issues by using taxpayer money to create publications, postings, curricula and handouts for students, teachers and parents. It also says that parents who refer to marriage by only its "traditional" terms in the presence of a gay teacher could be convicted of harassment. And students who believe that you are born just male and female could be reported as a harasser.
Analysts are afraid that this legislation will affect schools across the county. This is because textbook publishers must cater to their largest purchaser ... and that is often-times California. It would be too expense to have separate editions of textbooks for other states.

my ex and i decided on a custody plan. i got all the paper work from his lawyer in the mail on Friday i dont completely understand it all and according to his lawyer i cant ask him becuase he represents my ex. i talked to my tax lady cause the papers say i can claim her as a dependent this year and he can claim head of household, but he has to have her a certain amount of days to do that, she was born in July and resides with me in October we started the 50/50 custody, my question is if i called like legal aid or some place that offers free lawyers would they sit down and explain everything to me i'm not looking for someone to represent me, just look things over cause i dont think its very fair he could claim head of household when she was with me most the year until half the time this month. i'm just confused. he already got off easy and only has to pay 55 dollars a month in child support...help!
