In Kentucky, that would be an assault in the fourth degree, despite the severity of the injuries, unless the prosecutor can prove that when he shoved her, he intended for her to fall to the pavement and injure herself more severely. Assault 4th, here, can be proven regardless of injury.

Sheesh,
You all live in the wrong COUNTY!
All you have to do to get an assault charge here in boone county KY is BREATHE !
(and be an EX of a very crooked family who has power and political poof.) I tried goin out in the street to get my two year old son and the cops told me I was "resisting arrest"
LONG STORY, but my ex is a real winner. NOT!
Now he and his family try to keep me from doing things that involve anything with kids. Ive worked with kids all my life, and counsel with battered women, etc.
Its like a major OJ, Jessica, etc case, if ya got the money honey, and the power, ......Judges can be bought.
Its really SAD!!!
My ex has a record a mile long, but HIS DADDYs money and power erases it all........and IM the criminal!????
WOW! Justice in America!!!! So Sweet! So sad

In order to get an assault charge, you have to prove he intended to hurt her, or he knew that there is a good possibility his actions would hurt her. By your description, that may not be possible. You would have to describe the circumstances around the push. If she cut in front of him, there wouldn't be as strong of a charge as if he just randomly pushed her to be mean.

You would probably be able to prove disorderly conduct, that is defined broadly, and pushing someone hard enough to fall would definately be inappropriate behavior.

he could be charged with assualt. If he puts her hands on her then shoves her It would be percieved as intentional whether he meant for her to fall or not.

In my state it could be assault on a female, simple assault, battery.
Would depend on the laws of the jurisdiction where it took place.
