Renting & Real Estate - January 2007

This is the second time. I'm a single mother of three and thought buying a house would be a great idea. Now I'm stuck with a high house payment and an almost 100 year old house that seems to be falling apart. I really don't have the money to fix it up and can't seem to keep up with the payments and bills. Refinancing is out of the question, with it being in default now and even just before I was told my rates would actually go up about 3%. I don't think I could sell it for as much as I paid for it and I've only had it less than 2 years. Also I have a second morgage from the seller which is behind. I'd like to just walk away from it and let them take it but I don't really know what would happen. I just can't keep it up. Please if you know anything about this give me your advice. I really don't want to have to contact "this agency" or "that agency" or anything like that though. I don't like the house, area, or school and just want to get away from it all as soon as possible.

Last fall, my husband and I went to a modular home dealer and we were supposed to be getting a home/land package deal. The land is almost 3 acres. Total, the whole thing was around $200K. The land was $45K. That was supposed to include EVERYTHING from the appliances to the driveway and the initial clearing of the land and the driveway finished.
Nothing has gone right. The dealer lied to us repeatedly, will not take our calls, our home is not safe to live in (we are not in it) they have stopped work, they had my husband sign blank papers, and later they withdrew all but two thousand dollars and said the build was 90% done, when NOTHING was done, and I have all the permits that were dated a month after.
Our home was damaged when it was brought in, there are things missing that we ordered, we did not get a proper contract and I don't know what else I have forgotten over the year.
I cannot find a lawyer to take my case because no one knows what to do about it.

So I want to rent a house and I will not be going to a property management. But how do I know that the person I am renting the house from really owns the home? Is there anything I can do to verify that? Is this kind of fraud a common problem? Is it a problem at all?

I'm selling some rental properties and agreed to accept a "note" for 20% of the sales value as part of the deal to make it work. From what I understand, this is called a "subordinate note". How "secure" is this kind of transaction - that is, if the buyer defaults, what kind of remedy do I have? Is this the same as having a second mortage in which I receive monthly payments? How is the interest rate and term (number of years) determined? If the buyer stops making payments, do I get the property (or partial interest in it) back?

I live in a good area for 2 years near sea world in San Antonio, tx. They are building house like crazy around here, and builders are offering NEW homes, that are the exact same size as my 2 year old home, for the same amount which i can sell my home for. If I sold my home to day, I can make about 14,000.
Should hold on to my home and rent it out or sell it?

At my age of 24 and living in California, a house seems out of reach. However if the market rockets up again in the future, I'll rent for the rest of my life. It feels like my age group needs to make 100k a year because we don't have equity this late in the game for a down payment. Condos go for around 250k but charge for home owners dues, and homes start around 300k. Should I wait this out a little longer? Or should I dive in head first?

I live in Wisconsin. We haven't signed anything with the new landlord. If he could cancel our lease at any time, could we then get out of the lease scott-free?

I have a vacant property in Indiana now and there are a couple other rentals in the same neighborhood, so the competition is fierce in finding renters. Any creative ideas on how to stand out from my competitors? They are all offering $895-945 a month with ONE MONTH of FREE RENT! Truly appreciate it!

My sister in-law[single], on two occasions, found a man masturbating outside of her window. She called the police and has a police report. She spoke to her landlord about this and he said she still has a duty to fulfill her lease regardless but she no longer feels safe and has difficulty sleeping. If taken to court, will the court bend based on the circumstance?

I'm looking to buy a house and have a prospective real estate agent. He said his commisson rate is 6%. I was told by someone else my closing costs would be about 6% of the purchase price. Are they the same thing? If my house is 200,000$ then I would need 12% (24k) to cover closing cost and real estat agent commisson fee? Is that right?

The normal thing is to want the "American Dream", however, I'm 27, single, no children and I have no plans on getting married, but besides that, I have no real desire to own my own home, it just seems like a lot of hassel, I find it much more convienent to rent. Is home owning as glorious as it's cracked up to be? Should I reconsider?

I have been living in the same apartment for the last two years (it's a 4 apartment rental building), and it's going into foreclosure. The landlord moved out a few weeks ago and said I could live here until the bank kicks me out. I've been saving up the last few weeks for a deposit on a future apartment, but I'm wondering how much longer I have to live where I am now.

I guess the landlord knew about the foreclosure stuff for a while, but the only thing I've seen was something that came in the mail a few days ago. It was a court paper that said on January 11, there will be "an entry to foreclose" on the property. I live in a suburb of Chicago, IL. Does anyone have an idea of how much longer I can live here before they kick me out?

Also, what kind of notice do they give? 10 day? 30 day? Thanks
