Last fall, my husband and I went to a modular home dealer and we were supposed to be getting a home/land package deal. The land is almost 3 acres. Total, the whole thing was around $200K. The land was $45K. That was supposed to include EVERYTHING from the appliances to the driveway and the initial clearing of the land and the driveway finished.
Nothing has gone right. The dealer lied to us repeatedly, will not take our calls, our home is not safe to live in (we are not in it) they have stopped work, they had my husband sign blank papers, and later they withdrew all but two thousand dollars and said the build was 90% done, when NOTHING was done, and I have all the permits that were dated a month after.
Our home was damaged when it was brought in, there are things missing that we ordered, we did not get a proper contract and I don't know what else I have forgotten over the year.
I cannot find a lawyer to take my case because no one knows what to do about it.

Right now, I could care less if I ever live in this home, but I want someone in jail. Starting with the dealer for stealing our money. The Mortgage Company tried to foreclose, sent a letter and everything, but for some reason, have never acted on it. They were the ones who were dumb enough to send me the report where THEIR inspector filled out that it was 90% complete. I am at a loss at where to start with this, and I know that there are others who are having the same problem with this company.

If there are others who are having the same problem with this company, the group of you need to get together. Each affected party line out, to best recollection and proof, the dealings with this company - unfulfilled deadlines, pre-payments for services that were never rendered - so on and so forth. Make it as presentable as possible. If you have bond, insurance, or business license numbers on this company, even better for the record. Any records provided by the company regarding costs & timelines will be exceptionally valuable.

Take this information directly to your local Attorney General's office and let them know that, as a group, you feel you have reason for a class-action lawsuit against this company. Also contact the FTC (Federal Trade Commission) with the same information.

Report this company to all applicable BBBs (Better Business Bureaus). Since they deal in real estate and financing, locate their local real estate and financial Associations from the city, county, state, and federal levels and also supply this information.

Due to how you've been trying to deal with it, it will be a difficult situation trying to get this all rectified. Don't let a lazy or ignorant lawyer tell you that you have no recourse. And never, never, NEVER sign blank paperwork ever again - please!

Let me tell you something.! first, read and understand EVERYTHING that you sign. Nobody could take money from any account without your signature. Why would anyone sign a blank anything. I don't mean to sound like an A++ but you are guilty of compound stupidity. The attorney's won't touch this with such a history....They would take this to court and have to PROVE that you were taken. The Judge would know that fact but he can't form a legal opinion on what he thinks..He must deal with the law and what you can PROVE.If you contact the Better Business Bureau, the local Building Inspector, and some local Bank's that have experianced problems with the contractor,the manufacturer, and anyone else who may have had a part of this fiasco. I mean anyone, Plumber, electrician,general contractor, escavating company, whoever. Get all the information on paper. Never give anyone the only copies. Make duplicates of everything!!!!!! If you can't get enough info on them to prove guilty you are screwed.....You borrowed money, yiu have to pay it back, no matter what.......If the bank/mortgage company forecloses and they will auction the property off whatever they get at auction will be applied to the balance you owe. In the condition that you say it is in I can't imagine it bringing more than thirty percent of your supposed value. You will still owe the balance of the loan...Who has the Title to the property????? If you do not have it there is another problem..What state do vyou live in?? There is a couple outfits in Mass. that are bad news..Similar situations...If you talk to your District Attorney they might be able to help you. At least they might tell you what you need to proceed against the company you are involved with..I wish I could wish you all the luck that you need. The only alternate to all this would file for bacnkruptcy, not a pleasent thing to deal with but it could be a last resort. Dam'n I do wish you all the luck.!!!!!!!!!!!! there are others???
lawyers love class actions (where groups of people are wronged by the same person)
get the group together..this may take work..but.. an ad..or knock on door..and get them to put something in writing..
maybe someone will go with you..and make your work easier..

in a class action..where there is a group of you..you will not only find a lawyer...the lawyer will love it for the publicity..

get a group..going........
just of similar..complaints..from this dealer.. like poor delivery ..etc.. any complaint..
good luck.....and enjoy...

In a class action the lawyer gets lots of free publicity and lawyers love that..it also helps..bring an early settlement..

Unfortunately, that is a very common practice. When I lived in Podunk, Delaware I saw it happen a lot. That was the main reason I bought an established condo.

If what you say is true, it's pretty simle to sue for damages-- so why are the lawyers confused?

your husband should never have signed blank papers. it sounds like you have been swindled. if i were you, i'd keep looking for a good lawyer.
