My husband has a charge-off of $6700 from a lease termination in 2004. I sent a letter of dispute in July when the collection agency contacted us, and I just received their verification yesterday. This debt is valid...but I REALLY don't want to pay it...(who does??) :) The statute of limitations here is 5 years (Florida) so I'm not sure if I can stall them long enough on this. Any suggestions? How likely is it that they will seek a judgement to garnish wages or put a lien on, if I simply ignore their verification?? probably not a good idea...huh? What should I do now?

I closed a credit card account in December 2001 and stopped making payments some months later. A year or so later, I started making payments to a debit management service, but stopped in June of 2003. A collection company filed a lawsuit against me in June 2007 for this debit. There is a 4 year statute of limitations in California to file from the date of default. Does that clock start from the date of default to the credit card company, or the debit management service.

Hi

I loaned my brother over 10,000.00 in california ,had him sign a loan agreement with interest. Its been 2.5 yrs and not one payment .Can i put a lien on his property even though the loan contract dosn't state payment due by a certain date. Since its over the 5,000 small claims court price ,i'd have to go to a higher court (which one? ) . Do i need to go to court to apply for a lien for a unpaid loan . Again ,loan is at 7% interest but dosn't say when it has to be paid.

Thanks

I am in the state of Indiana, and I received a complaint and summons regarding an old debt on November 30. I pulled up my credit report and the last payment was made either in October or November of 2001 and I think it's now too old. Should I answer this myself, see an attorney, what?

I just found out that my dad payed for mine and my brothers tuition fee by charging them to his credit card and incurred circa $250,000 worth of debt through various credit cards that he's not going to be able to pay considering that his business is only source of income (personal business) is in jeopardy.

Credit card companies constantly send out notices via mail, since they cant reach us because everyone in our household changed their cell phone numbers.

Are there any LEGAL consequences that he can face such as jail time or repossessing his vehicles or house???

Thanks.

I have Helio as a cell phone company. They accidently charged me a early termination feel that I did not owe, and time and time again I was told by them that I would not have to pay it, and that it had been credited to my account. Now they have apparently reported this amount to an outside collection agency and are telling me that there is nothing that they can do about it, even though it was there fault, they are now telling me I have to dispute it with a collections agency who has been very rude to me on the phone. What are my options, what should I do?

I found out that something on my credit report was not mine, it was my mothers (we have the same name) I got it taken care of. I had applied for a car loan and my interest rate was 18.9% the lowest. At the time of applying I didn't know that this was on my credit. First question, will my credit score go up? WHen will that take place? If I applied for a car loan sa? in March or april do you think my interest rate will go down? What advice would you give in tips on getting a car??

One of my (3) credit cards sent me a notice that they will be increasing my APR from 12.99 to 21.99, eventhough the original rate was supposedly fixed. The reason they gave was that my other 2 cards have high balances. Fine, however, I just paid for a wedding and honeymoon, which is why they are high right now, but have been steadily paying everything on time and more than minimum, when I can. One of my other cards is at 10.9, and doesn't plan to increase on me. Why do credit card companies pick on good honest people like this? Why did my APR go from a fixed rate to a variable? They gave me the option refuse the increase by closing the acct. and just paying it off at the 12.99 rate. Would this look negative on my credit report if I do so?
