I am in financial ruin due to recieviing no child support for 7 months and am currently seeking the assistance of the State Of Fla Child Support Enforcement but they are telling me it's going to be Christmas before I can get a court date. This has been going on since May of this year. I have kept my nose above water for this time and now I am sinking I have contacted all of the credit counselors available including the United Way and because I have secured debt they can not assist me I only have 4,000 dollars of unsecured credit card debt. So since I have no chance of receiving help from credit counseling am I absolved from the mandated 6 months before filing bankruptcy? How does this work? And where can I find an Attorney at a very resasonable rate?

I received a medical bill from out of state and then less than 3 weeks later (19 days to be exact) I received a 'Second and Final Notice' saying that if not paid immediately it would be placed with an agency. 19 days doesn't seem like a lot of time before getting a collection agency threat - is this legal?

My brother had a car loan ($10,000) that he couldnt pay on anymore and had it repo'd. After trying to work with them, they decided to cut it off and take further actions. He hasnt received any letters but the last call was a wage garnishment threat. I know they have to take him to court and get a judgement first. He wants to know since in CA they can take up to 25% of his wages - can he fight that lower??? and HOW LONG does it take from the start of the last phone call to actually going to court???

He is not running from it, but wants to let his employer know ahead of time so they are not suprised and he also wants to lower his withholdings since he has other bills as well and needs to survive.

I'm trying to help my aunt who got a notice in her visa card state-ment from chase, that said there'd be a new way of figuring her finance/interest & minimim payments, coming up. She called them for infor. on what this would mean for her so she could plan for any increase but the reps claim they dont know nothing about the form she got, no one will call her back, & she's lost as to where she can go to decipher the long complex printed & undated enclosure she got. I also don't know what to tell her. Where should I call to get help with the answer, then worry about major complaining at later date? Is there a consumer rights place or something? Anyone else get the notice, & how did u handle it? Hurry! Thanks.

I just found a 4 year old bill from a collection agency in some of my papers. Thing is I pulled my credit report from all three bureaus yesterday and it wasn't on there. I would think it would be there by now.
Are the collectors not required to report debts or could it be that they aren't bothering because it would only sit on the reports for 2 years at this point?
I do owe the money. It's from an old phone bill.
I haven't received anything else from them since '03. Should I even bother contacting them or just ride it out and hope it doesn't show up on the credit report?

Well so have I. There aren't very many times I get fired up enough to try and do something about injustice in the world. I guess maybe it just needed to hit home before I felt the motivation.

Sure, being harassed be a debt collector isn't the worst thing that could happen to you, but it's still pretty bad. Being treated like less than a human is never fun, no matter who you are. Even if you really do owe the money they are asking, you still deserve to be treated like more than dirt.

So I made a myspace page called "Collectors Beware." I'm going to keep it updated with tips, stories, links, etc. Even if all it does is bring people together that have had similar experiences, that's good enough for me.

Please add me to your friends if you like to

myspace.com/collectorsbeware

If we all know our rights and decide to take a stand against these practices, maybe we can make things better.

Thanks :)

Also, why does my truth in lending say the APR is 7.762% ??? Does this sound like smoke and mirrors, or the best deal available. Credit scores are well into the 730's employment A+++..no issues there!
I know I am asking alot but any help would be greatly appreciated since I am 27 yrs old with 2 youngsters to look after!

My wife had a credit card that had a $2000 limit on it in 1994. She made payments on it for awhile, but stopped in 1997 when money was tight. She did not receive anything from the credit card company until 2000. She made arrangements to pay $100 a month and made them for 4 months until she realized that her principle was going up. She stopped paying again and argued that she could not continue to pay more than $100 a month, and that she was not going to keep paying to owe more. We bought a house last year and the credit card was on her credit report, with several late payments. But it also showed that it was current and was still owned by the credit card company. We have not heard from the credit card company since 2000, but that all changed last week. We started getting phone calls and letters saying that the account was sold to a collection agency and legal action would be taken if we did not respond in 30 days. Can they do this after 10 years or is it just a threat?

I graduated from University of Phoenix last year. They say I owe them 3k - I disagree but just want to pay and be done. I have tried to make payment arrangements (with UOP internal collections) for $150 a month until paid off and have paid on time since I made the arrangements but now they are telling me that if I don't pay in full they will send me to an outside collection agency. Can they do this?

I have been pressured into purchasing a timeshare, and have lost $900.00 to date. After several lies and frustrations, I am ready to walk away. I know my credit will be jacked up for a while, but thats nothing new. I am concerned that it will actually show as a mortgage foreclosure as opposed to an installment loan.

I've been reading different articles and blogs about paying off credit card debt and the one I like most is paying minimum on cards while you pay everything else set aside to one card and one card only until it's paid off. Then you pay minimum on the others while you move on to the next card and then the next.

I actually have quite a few cards, with rather higher minimum payments...
How detrimental would it be for me to not make the minimum payments (or any payment) on the other cards and use that lump sum to take care of 1 card in itself in only one month?
I have 4 cards that I could pay in just one month...if I didn't have to pay the others...

So I'm wondering how damaging it would be...
To skip paying all the cards next month...and pay one of the off completely.
Then the next month or two make the minimum payments and larger payments on the higher balance cards.
Then after a few months...not make any payments on a card and completely wipe out another card in a month?
