Take note.....

The Statute of limitations on debts begins from the last transaction or payment. If you pay anything...even a dollar...you will start the SOL all over again, giving them more time to harass you for the debt.

By the way..Curios is a moron! They do not have to accept any type of payment....and THAT I promise. This is a slick trick that many collection agents will pull on you...send us a "good faith payment" of $5 and we will work with you. But once you do that, you are stuck!

For now, try contacting the original creditor and see if they will work with you on setting up a payment plan.

If not, negotiate with the collection agency, but be sure they agree to erase any negative info from you credit reports once they have been paid.

If your debt has gone to collections, that means you defaulted on the debt. When you default, the full amount is due and payable, along with whatever other fees the contract called for.

So, yes, the collector has every right to tell you how much to pay. He does not have to offer any kind of payment plan. He could just take you to court, win a judgment, attach your bank account, garnish your wages, and lein your property.

If you are only offering a small payment, it probably won't cover the interest. You can go ahead and send what you can and they will cash your check. But it will not stop them from suing you.
