s. 43 of the Telecommunications Act 1984 of improper use of public telecommunications systems.
the question is - is it necessary to prove intent?
what are the mens rea requirements to convict someone for this offence.
would it still be a offence if the defendat did not intend to cause ditress or anxierty to the victim

the defendant has been convicted of an offence of harassment contrary to s. 2 of the Protection from Harassment Act 1997 and has had a restraining order imposed on him (under s. 5 of the Act). If the defendant were to breach the order, what should happen to him?

A He should be arrested and, where appropriate, charged and bailed.
BHe should be arrested and taken to court within 24 hours of his arrest.
C He should be reported for summons.
DHe should be reported to the court which imposed the order.

I am from Massachusetts and got a ticket in Hawaii for driving my friend's car that wasnt inspected. If I am leaving Hawaii and not planning to come back, and also because the car wasnt mine, do I have to pay this ticket? What will happen if I dont? Thanks.

I have recently been looking for handguns to buy when I turn 21 in a few months. I am eager to buy a nice size one for around 200. However, maybe due to the fact I am a criminal justice major I always worry about forensicly how do I know the gun has not been used in a crime? Am I thinking too hard? I know it's againts the law to rob from a store or steal someone's valuable belongings and/or money, and it's illegal to destroy someone's land or property (obviously there are big laws against arson). But what if someone stole something that was really only valuable to you, like artwork that you made and my not be something expensive or big, but is obviously something that you just can't go and "buy" another one at the store if you were to lose it or if it got destroyed? What if a person (even if that person didn't steal the work or break and enter the home) destroyed an art peice that belonged to somebody else; can that person be held legally accountable and would calling the police after an inccident like that be appropriate?

I was driving with my friend who was following me to my house in his car and he appearently made the cops suspicious of a drug deal (he loves acting stupid to have fun) so all of a sudden cop pulls his car over. I, being concerned for him pulled into the gas station right across from where he got pulled over and walked to him. I have only a learners permit, not a license so by law I have to have someone with a license drive with me, and like a retard when the cop asked me for my ID and said Have you been driving? I said "Yes" so he gave me a ticket for it, and my friend got off with a warning. Now appearently what I got charged with is a class 2 misdomenor. Has anyone else ever been charged with something similar? If so, how much did you have to pay, or how did you get out of it if you did?

Hi,
I just got a ticket for racing on highway. I was on the left lane and changed 2 lanes over to fill gas. The cop pulled me over in gas station. I explained him that I needed gas. I only had 2 gallons in the tank and I have proof for that since I filled up after that. The cop dint know how fast I was going. He suspected that I was racing with some other car and gave me the ticket. Let me know whether I should plead guilty or not guilty since it is 5 point ticket. How much is the fine for the 5 point ticket. Also, I got a ticket for unsafe lane change. How many points is that ticket and what is the fine for the ticket.

military son w/ no previous violent hx arrested for shooting friend w/ friend's gun off-base. Son under impression gun not loaded, did not check properly. Friend seriously injured. Son provided first aid until EMS response. Son initially lied to police as to who shot who...(? I have no idea why....panic?) Is being charged with attemtped murder and held by civilain authorities. What are the chances that something like this can be reduced? ...No preceding argument...these guys were friends..they were going to go out to the range...do not understand why this is the charge...We have already spent 2500 for an atty, he has not spoken with the victim yet, barely with my son...yet has said that it will be 10,000 to represent him for a trial. (He goes to the grand jury next....) I am afraid that he will end up with a public defender.. ...What should be the next step? What is likely to happen to him?

no charges have been brought, the person has not been questioned nor been arrested, yet this person has been told that the case is going to the grand jury. How can this be, this person can't get any answers to any questions regarding the case. The attorney just says wait for the courts to make their move and don't try to question the court, because if nothing is there and the attorney starts checking to see if something is there then the courts will start pushing for something to be there. Can someone explain how the system works.

Hi im 16 years old just got pulled over..well not really...i was going to taco bell when a cop seen me and followed me...he followed me all the way to taco bell. i parked the car and got out. when the cop tells me "come here" which i do so. the cop gets all my info. there was 2 cops riding in the car when the cop that was getting my info asked the other cop what do i put as the location of offese..the other cop told him to but the street when he seen me...but i was at taco bell a block away and didnt do anyting to get pulled over can stuff like this be beaten at court?...oh yeah i live in irving, tx
