it should be for nonpayment of services rendered, because she still had consensual sex with him payment or not.

NO, IT is NOT right, BUT can it happen? YES, it all comes down to her word against his. BUT if he can prove that he wrote her a check, then this might change everything. BUT, I don't know of ANY HOOKERS stupid enough to take a check. There was a major rape case here in MA a few years back where a woman was raped in a bar on a pool table with everyone watching. INCLUDING the bartender. ALL were convicted of the rape. BUT rumor had/has it that this woman had agreed to have sex with these guys. BUT they decided NOT to pay her and she cried rape. They went to jail. BUT a few years later she was killed in an auto accident in FLA as her brakes failed on her car. WEIRD huh?

It's theft by deception, fraud, and bad check charges to start. It's potentially rape, since she didn't consent to sex without payment.. Always pay the girl if she performs as agreed - she has a hard enough life already.

No that is not the correct, it wasn't rape. Regardless if he paid her or not, a more appropriate charge would be failing to pay for services rendered. The next question is whether or not her services were leagal where they occured? More than likely they were not, so the correct charges should be prostitution for her and soliciting prostution for him.

No, it should be either a theft of service charge or a bad check charge, Rape is pretty far fetched....unless it was.

it should have been for not being paid for services rendered
now if he had not even offered her payment i would say it would be more appropriate for, but still probably just not being paid
