i spent 5 years in a criminal defense law firm as an investigator and trial assistant. when we had walk in hours for people to come in and apply for attorney representation, it was my job to interview them and determine which ones we'd represent and which ones we would not. the following are common excuses i've heard over the years...

-murder-self defense
-robber-poor and stole to help kids, family, etc
-burglar-i didn't do it
-con artist-i was framed
-rapist-victim gave consent
-aggravated assault-in defense of others
-drug abuser-life was so bad i had to get high
-abuser-didn't do it, other person lying
-arsonist-oddly, never dealt with an arsonist
-larcenist-money was owed, it was my property, accidentally took it, had permission
-not even going to answer retardist.

Well, it varies. "You got the wrong guy" is common in all crimes. Rapist also use the consent defense frequently and child rapist often argue coaching. My favorite all time excuse by a drug user was "Them ain't my pants" It went like this: "Yeah, I know the police found crack in my pants, but you see, Miss DA, it was dark that morning and just grab them pants and puts them on. Turns out them ain't my pants, them my cousins pants-I swear that ain't my crack" More often, drug offenses use the excuse of the cops planted the drugs on them or "jacked me up".

I'll bet in most cases, they would use the SODDI excuse (Some Other Dude Did It)..

Normally it is:
I didn't do it, wasn't me.
I didn't mean to.
My friend did it and is framing me.
It was an accident if I did do it.
Do you have pictures, it was my cousin.
