A non certified judgement has been placed against my seller's property. According to him there was no monetary awards in the case. We have a buyer to buy the property but the title company is asking to take 10,000 at closing for a month and then return it to him if it is unclaimed. Is this a good idea? He is very concerned? What would be the best course of action r this?

Can a landlord or any management company ask for my bank accounts- savings and checking numbers and also the balance of each account. Is it legal in california & los angeles?

Under the following conditions:

- Both spouses work and make equal amounts of money
- Only one spouse's name is on the loan and deed
- Only one spouse makes payments on the house
- The couple splits all other bills (electric, water, etc) down the middle, with each spouse paying exactly half
-The couple were already married when the home was purchased
- The home is used as the couple's primary residence

In case of divorce or separation, does the non-buying spouse have any legal claim to the house? Will judges force the buying spouse to split the equity in the house with the non-buying spouse because they were married when the home was purchased?

I have a friend that cannot make his monthly payment and cannot sell his home for what is owed. The bank is offering to do a short sale in which the buyer will pay less than what is owed and he would have to agree to pay 5K over 5 years at zero interest and will be 1099ed 35K to claim as income on his tax return. The other option is to say no and let it get foreclosed. Which is the better option?

If he lets it go to foreclosure would he owe anything? Should he consider filling bankruptcy and what are the consequences?

We have had lots of problems with our current landlord. She doesn't speak english well and therefore doesn't seem to understand our rights. She has come up to our SEPERATE apartment without permission before, once she brought a man from the gas company without giving us notice or even mentioning it until we got in a fight with her. She yells at us if we leave a fan on for long or once we went outside and left our tabletop fan on (all utilities are included) We asked a police officer who said she isn' allowed to do any of this and it's harrassment.

We are unsure if the walls being marked up from furniture would constitute normal wear and tear or not. There are no holes.

What is the new landlord allowed to ask her on the phone? What is our current landlord allowed to say? We're worried she is going to mention the fights when they were more her fault than anyone elses.

Yesterday my wife and I signed a 4 month extension to our rental lease on our apartment. Later that day someone taped a copy of the lease to our door that had been altered ($50 dollar increase to rent per month).

Is it illegal to alter a lease after it’s signed? Especially without any kind of notification...

Any suggestions as to what we can do?

We are pretty new to Florida and don't really know if there are any specific laws that apply here in this state.

My realtor listed my rental property as having air conditioning when it does not. Tenants signed on for the house and then realized upon moving in that there is no air conditioning. Am I responsible for providing window units to the tenants? I'm being asked to buy 6 window units when I had no desire to do so.

We have apt rentals,in which we have 6 month leases. If after the 6 months are up, and our rules are, that the tenant has to give a 30 day notice of vacating, or they forfeit their deposit. Now the tenant is on a month to month, he would still have to give the 30 day notice in order to get his deposit back, right ? Just as we would have to give him 30 day notice to vacate. Please give me answers on this. My tenant thinks he can move out on the 6th, he just told me about moving, and he thinks he should get his full deposit back.

My mom wants to sign her house over to my husband & I. We are already living in the house and have been paying the mortgage payments, the house is just in her name. I have read about a "quitclaim deed" is that something that we can do or will we actually need to go through the process of buying the house to get it in our names. I have been living in an apartment for 4 years now. I don't have any immediate plans to move out (atleast not 2+ years)

The carpet installed is the commercial kind you see in office buildings, and my kitty thought the hold rug was a scratching post. I have pull marks in certain areas of the carpet in my living room. the bedrooms are find as well as the hall way. My stair was it worste.

I lade down area rugs and this fixed the problem for me visually. I am responsible pet owner and am able to repair for the replacement of the carpets when I move out, but I am wondering if they will charge me the replacement cost or the depreciated cost. I don't think it is right that I am buying brand new carpet for the landlord when I move out as a 5-6 year old carpet would have some normal wear from use.

I am selling my house and currently have it listed with an agent. However, I just discovered that he lowered the list price with out asking me. We had a set price in our contract, so I know what he did was wrong. The catch here is that he just brought me an offer tonight. could my husband have gotten a loan on a prime equity line with out my signature ??????? we bought a house 6 years ago and one the deed it states his first and last name and the words...(as a married man) ......my name isn't on there,,,,but on the mortgage it is...
