I owne a property and have 2 mortgages on it, ones is for about 100k and the other about 15k i just found out that in about 2 weeks the smaller one is foureclosed on, which, is news to me. i am trying to figure things out with the morgage company before the sales date, but if it does go to auction before i can resolver it, what will happen to my larger morgage? Do they make me sell it or do i get out of it. Does anyone know. i am paid to date on my larger one, and i thought i was on my smaller one. Can they still take my house even though i have paid everypayment of the 100K one? This is in Ohio, thanks to all that answer

from the past. We don't have any bank statements at all as we both never had any accounts. Not sure what to do? We are so ready to close on this house and then this has to pop up. We just opened two accounts in our names last friday but that was last Friday. HELP?

I want to offer an extra commission to the agent that brings/represents the buyer of my home. I prefer to offer a fixed amount structured like"$2000 cash to the agent that represents the buyer of my home if it sells within 90 days of listing, and if the purchase price is within 3% of my current asking price". I want to make sure such an agreement or offer would not scare away any agents, nor would it violate any real estate agent brokerage agreements or ethics related policies. My goal is to motivate the market...so is it in my discretion to offer whatever creative perks/incentives I am comfortable with and know that if an agent decides to turn down the offer, no harm done? Obviously I don't want to leave the cash offer open ended because if the house takes a long time to sell or I am forced to accept an offer that leaves me little equity, I don't want to offer the cash.

Can I (buyer) back-out of an offer verbally if seller counters or do I need to sign some documents to back out and get my deposit check back? I can't trust my real estate agent. The property is located in Los angeles area.

My husband is going to graduate soon (I've already done so) and now we're trying to find a place to live. He's going into the medical field, so we can basically live anywhere where there is a hospital. We want to live somewhere between Idaho and Michigan, but none of the southern states. There has to be high mountains, and lots of trees and lakes. We're starting a family, so most importantly, there must be good schools and family-friendly neighborhoods, including low crime rates. And (as if we weren't being picky enough), we'd like to live in a place that isn't too much in the city but not too far away, say a town of 15,000-30,000. The places I have looked that seem the closest are Pennsylvania (I know, it isn't between Idaho and Michigan), Missouri, and Minnesota. Any good suggestions in these states or others? I am willing to research as many suggestions as I get, so please don't be shy. Thank you

I have a house that I bought 7 years ago in an "up and coming" neighborhood. After 9-11 and a bad divorce, I have now tried to sell it for over 5 years. I owe $264K and it appraised at $230, but comprable houses in the neighborhood are selling at $195K. I have had 6 realtors but no one has been able to sell it. I have had one offer in 5 years. The house is gorgeous, historic and in great condition, but I am in a rut. I can no longer afford to pay two mortages and am sick of renting it out. I can take a loss, but that doesn't even work. Can anyone help me? I just want to unload it, but don't want to ruin my credit. HELP!!!!!

My parents (thank god for them) want to offer me a loan (in lieu of a formal mortage) so I dont have to pay the bank interest. My parents will charge me no interest. They are going to give me a lump sum to have at closing to buy my house outright. Will they need to file the lump sum as a gift if its a legit family loan? Do I have any tax issues to worry about? My girlfiend is currently at the end of her lease which ends on either June 30th or July 1st. She has already found another place to move into on the 30th. The apartments she is at is saying that they require 30 day notice in order for her to leave. Is that true? Is notice needed? Won't the lease just expire on the date? They are saying they need notice (which she had sent today) and the date on the notice is for the 20th of July. So will she owe a prorated amount for the apartment even though she will not even be living there and the lease is ending?

I attended REDC foreclosure auction in Los Angeles last month and now I am deeply regret it. We have a problem verifying what the auctioneer said at the auction about the property that we bided and won, and what they told us later. They said that I have no proof of what the auctioneer said on that day and because of that it might cost us about $10K if we to walk out from the deal. So, I want to know how to find out if there is anyone that went to the auction on May 19 at Convention Center and tape record the auction? How can I find out if there is any reporter from any magazine or TV channel at tape recorded the auction on that day? I don't want to say this but don't believe the auctioneer although the auction company is well know and might be around for a long time. Always think that they are there to take your money and they are not your friends, you are on your own. They will not stand up for you and will not back up what they said. Be very careful.

I know that military housing allows for you to have the number of bedrooms that you have depends (ie 2 bedrooms if you have 1 child). We are about to move to a different station (NAS Pensacola). We are currently pregnant with 2nd child. Can we go ahead and get a 3 bedroom, or will they make us get a 2 bedroom and then request 3 bedroom when we have our child?

I closed on a mortgage loan in March 2007. My lender inadvertantly did not request a copy of a paystub during the underwriting process.

The lender realized this error when they were trying to sell my loan to an investor group. They say they cannot sell my loan until I provide this information. They acknowlege that I am under no obligation to provide this information at this time but the lender generally does not service loans and they say they could not service it as well as the investor (a well known investor in mortgages)

On one hand I feel I should help them by sending a paystub. However, this is business. If I was 1 day late closing my loan and my rate lock expired, they would have charged me a fee to relock my rate.

Also, I am not sure if there are any issues I am not considering. Any advice is appreciated.

What can happen if you are the seller of a piece of property and a few days before scheduled closing you want to back out of the Purchase and sales agreement?

What can the potential buyer do? Can they sue the seller? What is the basis of proof the buyer would have to show in order to receive damages?

Anyone ever personally back out last minute? What were the consequences? Did you have to pay the potential buyer off?

It's a long story so I'll start from the begining. I live in a room in a shared house (I have key to my own room). Before Easter the house was raided as the Police were trying to arrest one of the other tenants. As they weren't sure which room/flat was his the broke down all the doors from which they got no answer, including mine. The lock was held on by one screw and was not secure. I spoke to the landlord and he agreed to give me a new door/lock, which he didn't do for another month. In the mean time I was burgled whilst away for the weekend (if you can call it that, as door only needed a push) lots of my stuff was stolen, my tv, iron, handbags, perfumes, even clothes. They totally ransacked the place. I reported to the Police and they said they would have words with him, not sure if they did. What I need to know is can I make some sort of claim from him to replace my stuff? I have been told he should have liability insurance by law and I may be able to claim through that. I'm in UK

The house is a seasonal cabin on land owned by another party. Every year we pay a rental fee to use the cabin on the land. When we bought the cabin (from another party, not the landowners) we agreed to pay the "summer rental fee" every year. However, the landowners are now taking away our right to sell our cabin to another party. They have stated that we need to either (1) take our cabin off the property or (2) continue to pay the "summer rental fee", which by the way keeps going up by $200 every summer.

I feel that we bought our cabin with an "understanding" between myself and the property owner that cabins could be transferred to new owners. No physical document or agreement was signed by me or the owner so can they do this? This has been a precedent for over 30 years at this place.

Also, what can they do if I leave the cabin there and don't take it down? This new policy is being forced on myself and about 100 other cabin owners and it just seems really unfair.

What have we overlooked when it comes to tidying the place and checking to make sure they're clean?

Stove
Window and sliding door runners
Clean floors
Clean toilets

Obviously these are things that are always clean and are being cleaned routinely but I just want to make sure that nothing has been overlooked and if any one has any tips to pass the inspection?
