My girlfiend is currently at the end of her lease which ends on either June 30th or July 1st. She has already found another place to move into on the 30th. The apartments she is at is saying that they require 30 day notice in order for her to leave. Is that true? Is notice needed? Won't the lease just expire on the date? They are saying they need notice (which she had sent today) and the date on the notice is for the 20th of July. So will she owe a prorated amount for the apartment even though she will not even be living there and the lease is ending?

In most states, failure to notify the landlord that the expired lease will not be renewed automatically defaults the renter to a Month-to-month lease agreement. At the end of a contractual lease, the renter is normally required to give at lease thirty days notice that they intend to vacate the premises.

You can check your state statutes, but my guess is that she needs to give the appropriate thirty days notice according to law.

It really depends on how the original lease is written. She would typically owe the prorated rent since the landlord would not be able to clean, paint and rent the apartment with such short notice. Why pay twice? She may be able to negotiate a later move in date on the new apartment.

Read your contact first, if such language appear, there is nothing u can do. If not, than you tell them so. Also you tell them, “That you will go to a better business bureau to solve this disputed”. You make sure to leave the apartment in clean manner (broom clean), so they will not charge you with any thing beside normal wear and tear. When u cleans the apartment, remember to take pictures of all the apartment walls and other areas. Good luck, buy a house keep our economy going.

Each rental agreement is different, but ordinarily notice is only given if one plans to remain Her notice should read that she will not be renewing her lease when it expires.
