I had knee replacement surgery and, after many months of pain, the doctor discovered that the knee cap had moved down and to the side of where it should be. The second surgery was a success but I don't feel that I should have to pay the co-pay fee for surgery that was needed only because the first one was not done correctly.

What constitutes financial incompetence? Does filing bankruptcy (with 10,000 in a reposessed car, and 3K on a credit card-thats it) automatically put me in the 'financially incompetent' category? Can I still file a bankruptcy (like so many other people do) without any reprocussion from SSDI or the V.A.? I pay all my bills on time, I always have atleast 1K in my bank account. There are only 2 creditors in the world that are after me. Is there any way that I can be considered financially incompetent simply by filing a bankruptcy. Is there a 100% clause where you file bankruptcy and your automatically 100% incompetent?

I owe 10,000 on a car that got reposessed. Thats the only thing I owe on but thats quite a bit. My only income is SSDI and disability from the V.A. How do I go about filing a bankruptcy? Is that going to classify me as financially incompetent? Will I be cleared of all my debt and be able to start over fresh? Or will I somehow haveto pay them money? I just dont understand, I have been told that even if you file bankruptcy you still haveto pay creditors... So whats the point? Is there any way to wipe out my debt completely (in kansas) without having to give anything to creditors?

I dont have a job, my only income is SSDI. I had my car reposessed. My lawyer actually told me to ignore them because they cant get my money, they cant do anything even if they take me to court. But now that I want to ivest my money into the stock market.. I am worried that somehow they can 'get me'. Are these assets still protected because they came directly from SSDI?

Ok, I quite gambling about 3 months ago, but I just recently had a relapse, and drained my checking account, I also took out my wells fargo personal line of credit, thinking I'd use it to pay some bills until I got paid...but I ended up draining most of that too. I'm in college right now(taking summer classes)...Besides my student loans, I've got $3400 on one credit card, and $2200 on another, and now this $950 personal line of credit. This one gambling site said they'd refund $1000 of the money I used, because I was banned from their site for a gambling problem months ago, but now they're saying they won't give the refund. So I'm gonna dispute the charges. I taped the conversation where they said they'd refund the money(putting my cell phone on speaker phone and using that windows recording program), so I'll use that as leverage against them. I'm planning on using my stafford loans in the fall to pay off one credit card, and the wells fargo loan. Any advice?

When a job does a check on your work history, what is included? Is it just the job and how long your worked there? Does it include if/why you were terminated? Who keeps these records? Also, does the company have to charge to get a work history report? and how much?

I want to fix my mistakes by clearing my debit, however, I lost my job back in December 2006. (I was denied unemployment benifits.) I currently stay home with my two children. (No job will pay what I need to make in order to pay childcare.)
Now I am really in trouble. I received a summons to appear in court in July for a debit I could not pay. I receive phone calls all day long for 3 other credit cards. AND we struggle every month to pay our mortgage, car payment and utilities. I can't file for chapter13 or 7. I called about a debit conslidation loan, our rating is too low. I have plans to get financial counseIing. But still what should I do about this mess I am in now? Does anyone have any GOOD ideas?

My car is a 2006 Cobalt. It has been in the garage more than on the road. I owe $19000 on it. Now, the engine is blowed. I can't afford the monthly payments or insurance on it. The warrenty has expired because of the millage. Should I let it go back to the bank? I can/t afford a new engine and transmission and air conditioner, or body work done to sell it.

Right now I'm getting turned down for alot of jobs because I have alot of bad debt due to marital problems. Since I can find a job the debt just gets worse! Good Old Catch-22.

My question is, since employers cannot use a bankruptcy against you in the hiring decision, would it be better for me to file bankruptcy? Would that actually raise my chances of getting hired?

My sister is bipolar, will never be able to work, is on welfare and somehow managed to run up $15,000 in credit card debt. She clearly will never be able to function in the real world again, so doesn't care about her credit rating. Bankruptcy costs $1500 to file, where she lives in Canada, and she is thinking she will just not bother. She hopes the credit card companies will stop calling and one day just write off her debt if they can't find her. Is she correct? What should I advise her to do? She can barely cope with life and needs advice.

Less than a year ago I bought a car. Since then my financial situation has changed dramatically to where I have doubts if I will be able to pay for it or not. This might sound naive but is there any way I could just say I wanted to return the car and not be liable for the remaining payments instead of waiting for the inevitable which is my not being able to pay on it?
