Right now I'm getting turned down for alot of jobs because I have alot of bad debt due to marital problems. Since I can find a job the debt just gets worse! Good Old Catch-22.

My question is, since employers cannot use a bankruptcy against you in the hiring decision, would it be better for me to file bankruptcy? Would that actually raise my chances of getting hired?

Job aside, if you are up against it, bankruptcy may be the answer. Keep in mind bankruptcy laws have undergone some changes in recent years. Consult an attorney who specializes in bankruptcy, don't go to any ol' lawyer. When you see him or her, know your numbers.

Are you sure your credit is the cause of being turned down for the jobs? I mean, have you gotten to the interview and reference checking stage and then not been hired? I am not sure that all jobs require a credit check for employment, mostly just those dealing with finances. Bankruptcy is a big decision; i would make sure it would improve your hiring potential before filing if that is your only reason.

Which sector are you looking for employment in? Usually they don't care about your credit history unless you are handling cash or working in the financial industry. Go to an employment agency and ask for factory work so that you at least have an income of some kind. As for bankruptcy, there are many alternatives including credit counselling where they communicate with your creditors and negotiate to have your payments broken down into small affordable chunks.

If you don't mind having the bankruptcy on your credit history for the next 10 years then I would advise you to go for it, if it's your last resort.

I doubt you are getting turned down for jobs because of your credit, but it is possible, especially for certain jobs.

Try repairing your credit before you file bankruptcy.
