For the past several years I have been working on a self-published comic book. The name of the comic is also the name of the character. The name is very simplistic, let's pretend the name is "Cat". My comic has recently been picked up by a major publisher and we are working out the final details of the contract

However...

There is a man who wrote two short stories several years ago, both published in a little known magazine or book, with the main character named "Cat" (I believe the name was also used in one of the titles). He is claiming that he has the trademark right to this name, because his work was published a few years before mine, and wants to turn the story into a comic. I filed online for a trademark of my comic, however, I learned he filed for a trademark as well, just two days before I did.

My question is, would his two stories and an intention, without any artwork or character concept, be protected by trademark?

Well, I'm 16 and of course teenagers tend to speed, and I fully admit I was exceeding the speedlimit but not as much as the cop stated he clocked me for. I am positive I was only going 40-45 (posted 25--not cool) but he said he clocked me at 62 I believe it was. Now, I have a court date and all, but could I substantially prove to the court that it was possible that he clocked the guy behind me who was speeding to go as fast as I was while tailgating me- my initial reason to exceed the speed limit. There isnt anyway I could have been going that fast as there was a big construstion truck with it's hazards on, no more than 150 yards infront of me. My ranger does not have that kind of power. I'm just really worried because it is my first offence and I heard there was possible Jail time. Does anybody have any suggestions as to what I should do?

ok so as you may or may not know I am a kinda a new music artist and I wanted to mix up the voices on my album some, So I found this solo artist who is really good and I liked his style so I asked for a collab. I paid him 100 dollers to be featured on HIS song [the beat he bought from another producer, he wrote the chorus/first veres/and last veres, and I got the middle] I also have emails from him saying its ok for me to put it on any CD I want and make money off of it and he dosent expect any more money then the 100 dollers already paid. Will emails hold up in cort? can he still sue me later if he wants? and how long does he have to act legally??? can anyone help?

Hi I am a college student, and live in Pa. I received a check in the mail for 3251 dollars from a fake company called iRecruit. I cashed the check at a check cashing place and sent about 2800 back to the people (please don't tell me I was stupid.....I know!) Now I am being charged with fraud. I want to know since this is my first offense will I receive jail time?
I was told I would receive community service and probation and I can pay 150 to get it off of my record. I am so scared and have no idea what to do. I have never so much as getting a traffic ticket and now I can be going to jail. I was thinkg about going back to the check cashing place and asking if I repay the money will they drop the charges.
I really wasn't thinking at the time, I was a college student and was broke! Will they drop the charges if I have all of the paper work from the company ?
If any one can help please do?
Also if anyone know any websites I can get information off please send it!

My wife and I filed for Chapter 13 two years ago and have a little over 2 years left on paying the debt back. This payment is taken out of my check each week. I will be filing for divorce in two weeks and I am curious if anyone has been through this or if any one knows what will happen. Will I have to continue paying all of this...will it be split...will I have to pay it plus child support? We have a 12 year old daughter. Any help is appreciated. Thanks!!

My husband was on his way to work one morning and stopped at a shell station in a rich neighborhood. He went in to get something to eat and use the restroom. He went into the restroom, used it and came out of the stall to wash his hands. As he was walking toward the sink he slipped on a puddle of water (didn't see it) fell forward and slammed his head into the porcelain sink. He stood up, walked out of the bathroom and fell on the floor. He didn't pass out, but came awfully close. When he stood up he had blood all over his face and a pool of blood on the floor. They called the ambulance and he ended up having 16 stitches in his eyebrow and a mild concussion. He missed 3 days of work. The accident was reported (one month ago) and the people at the shell station want to give him 75% of his lost wages and pay his medical bills. THAT'S IT!!
Now my husband threatened to get a lawyer and they said "Oh no, there's no need to do that." Should he get a lawyer? How long will it take?

I you have to miss work to take care of a disabled family member and are fired for missing that time what organization will represent you?
Mind you, my employeer knew about the dissability(multiple sclerosis) and knew that it was unpredictable and this person depends on me. Legally I can't let their health go bad so I need some links and advice as to where I should be looking.

i have to go to court next week 'cause i got arrested for "shoplifting". i walked in riteaid with a new bottle of lotion & 2 new eyeliners then when i was about to leave they stopped & accused me because the lotion was sticking out of my pocket

an employee just reached in my pocket & took it without even asking or anything & says "why are you jacking stuff?" so i argued with him & he called the cops. they arrested me but let me go that same day but i still have to go to court. the guy said that he didnt even have me on camera but he supposedly saw me. i have never stolen anything & i dont have a record. so whats gonna happen when i go to court?
and another thing, they didnt even sell the lotion i supposedly stole

I was rearended on a Highway when traffic was forced to stop because of trash that was thrown in the middle of the road. "troubled" kids were out picking up trash and one of said kids took a bag and deliberately threw it in the middle of traffic traveling 65 mph! (police issued said kid a ticket for causing the accident!)
The full size van behind me was unable to stop in time and smashed into me from behind which sent me flying 75 plus feet across another lane of traffic and into a ditch. Totalled my car, I am in extreme discomfort and unable to sleep. Constantly picturing the van in my rear view as I very easily could have died if more traffic had been around. I'm fully insured, as is the driver of the van; and my company said they will handle the claim for me and get me reimbursed for everything... would I have better luck with a lawyer, obviously I want to get all that I'm entitled to and make sure the kids aren't able to do something like this again. Suggestions?

The Lancet published two studies on the effect of the 2003 invasion of Iraq and subsequent occupation on Iraqi mortality, the first in 2004, the second in 2006. The studies attempt to estimate the number of excess deaths caused by the occupation, both direct (combatants plus non-combatants) and indirect (due to increased lawlessness, degraded infrastructure, poor healthcare, etc.).

The first survey published on 29 October 2004, estimated the risk of death following the 2003 invasion and subsequent occupation of Iraq to be 50% higher than that prior to the invasion. This led to an estimate of 98,000 excess deaths (with a range of 8,000 to 194,000, using a 95% CI (confidence interval). The authors called this a conservative estimate, because it excluded the "extreme statistical outlier" data from Falluja. If Fallujah were included, the estimated increased risk of death was 2.5 fold (95% CI: 1.6 to 4.2). The second survey
published on 11 October 2006, estimated 654,965 excess deaths.

Monday I got a parking ticket on my car at 10:50am.
It stated it was issued the day before (Sunday) at 2:40pm.
Violation: 32903 FMC Not Paralled w/ curb
Description of Violation: Vehicle is R/F tire not paralled w/curb (18") Facing wrong direction
Sunday, I came home at 2:25pm, I parked paralled, <18" from curb, facing the right direction. I used the car again at 4pm, there was no ticket. (I did park facing opposite direction, < 18" from curb after 4:30pm Sunday). I believed that the ticket was issued to meet a quota and wrote a different date and time.
I have a Corolla, the ticket stated that the model is Ter. The color stated was incorrect also. The License number and last 4 digit of VIN were correct on the ticket.
Should I pay or fight? I believe that if they want to fine me, they should not lie on the ticket and take the trouble to get the correct information.
It is a $60 penalty. How do I know if the penalty is correct if there are so many incorrect information

This is family land divided in 2 different sides - The O's and the C's. At one time, this was one family. The property has been passed down to children and grandchildren. The O side built a gravel road (private) to divide each side. This is the only road developed (on O servitude) for the C's side to get to their homes - permission granted. Of course, each year, we put up monies to keep the road up, where others do not. Over the years the O's has sold their property and homes to people outside the family. They allow usufruct to THOSE people to get to their homes. OK, I want to sell my home now. What the O's are telling me is that they will not allow the new owners usufruct to their property? IS THIS LEGAL?? When my husband and I retrieved our map for the C side (surveyed) their is a 30' servitude, but NO road developed. Please help me with the legalities of this issue.

My mom and dad have been divorced for almost 20 years. My mom is disabled and living on state's care in Washington, with some assistance from family. She recently told me that, per the divorce settlement, my father was to pay her life-time alimony. However, once she moved from California (where the divorce was granted) to Washington my father never paid her any money. She was getting asssistacnce from her parents, so she never really went after him but now that both of her parents have passed, she has very little money coming in. Can she go after my dad for alimony again? Where would I be able to get a copy of the divorce settlement? Would it be on file with the court after all this time? She wants me to look into this for her, but I'm not sure where to start!
