I was rearended on a Highway when traffic was forced to stop because of trash that was thrown in the middle of the road. "troubled" kids were out picking up trash and one of said kids took a bag and deliberately threw it in the middle of traffic traveling 65 mph! (police issued said kid a ticket for causing the accident!)
The full size van behind me was unable to stop in time and smashed into me from behind which sent me flying 75 plus feet across another lane of traffic and into a ditch. Totalled my car, I am in extreme discomfort and unable to sleep. Constantly picturing the van in my rear view as I very easily could have died if more traffic had been around. I'm fully insured, as is the driver of the van; and my company said they will handle the claim for me and get me reimbursed for everything... would I have better luck with a lawyer, obviously I want to get all that I'm entitled to and make sure the kids aren't able to do something like this again. Suggestions?

I wonder if there is some sort of program that should have been supervising the kids... should they be help responsible or the kids themselves... probably won't see a dime from troubled kids' parents.

If it was a non-profit organization, of course I wouldn't pursue that, hopefully they realize what could have happened and make appropriate changes. However, if it was state run and they had BAD kids in that sort of position I would want a lawsuit just to get that changed! Bad kids making bad choices shouldn't be anywhere near 65 mph + traffic for their own safety, let alone the damage that coul dbe caused. And hey, the crap head who couldn't stop in time is raising YOUR rates and MINE. Now maybe my greedy self can get some of your tax dollars too....

Don't settle this or sign anything without a super lawyer. The lawyer will take a percentage but should get you more than enough over what the insurance companies want to pay you, to make it worth your while. The insurance company, even yours is not your friend at a time like this. Your body probably has damage you don't know about yet and it will worsen with age. Please see a lawyer.

Yes ma'am I would get a lawyer and the person in the Van that hit you would not be the one getting sued for damages, yourself and the driver of the van should both seek legal assistance and I would sue the child's parents, since you can't sue a minor. There is already proof of the accident as the police wrote the child a ticket giving him (his parents rather) full responsibility.

Your company will settle your car and limited medical bills with the driver of the van. The rest of your bills, and time off of work will be yours to settle with his carrier.

Personally, I'd try to settle with them directly. You will need copies of your medical bills, and something that states how long you were off of work and how much you make. Even if you took sick leave, you are entitled to be paid for that, since it won't be available if you need it later.

Only if you cannot settle directly should you get a lawyer. Typically a lawyer will get you about 10% more than you can get on your own, and will charge you 33% of your settlement to do it. Net loss of 20% over what you can get yoursef.

Your company said they will handle everything and get you reimbursed for everything and you think you could do better than that?

I suggest you be glad it's that easy and get over it. Lots of people have horrible wrecks and you got off easy, hon. What would you sue for? What more do you think you should get?

Now you want to sue a probably non-profit organization?!?!?! Will the greed ever stop? As long as you get your bills and car paid for, what more are you entitled to? I might get a lawyer to make sure things go smoothly, but I can't believe you're so greedy to want more than that!

PS Thanks for raising MY insurance rates with your greed.

so you have the legal protection cover added to your car insurance? Not sure if you're in UK but it costs about an extra £15 or so a policy. If you have that will cover the legal costs of your claim. Check your policy.
Car insurance companies have their own legal advisers and they are specialists in this kind of damages.

Go to the citizens advice, they can tell you the pros and cons of various ways/schemes of pursuing litigation.

Hope you make a full recovery. Must have been frightening.

Need more information. But, you should show it to a local lawyer. Most will answer one question without charge.
